RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Amendment, Renewal
and Extension of Interlocal Agreement by and between the City of Lubbock and Texas
Agricultural Experiment Station, and any other related documents. Said Agreement is
attached hereto and incorporated in this Resolution as if fully set forth herein and shall
be included in the minutes of the Council.

AMENDMENT, RENEWAL AND EXTENSION
OF
INTERLOCAL AGREEMENT
STATE OF TEXAS §
COUNTY OF LUBBOCK §
This Amendment, Renewal and Extension of Interlocal Agreement (the
"Renewal") is made and entered into by and between the Texas Agricultural Experiment
Station (hereinafter called "Station"), and the City of Lubbock, a home rule municipal
corporation of the State of Texas (hereinafter called the "City"), pursuant to Chapter 791,
Government Code.
WHEREAS, pursuant to that certain Interlocal Agreement dated on or about April
11, 1996 (the "Original Agreement"), the City granted to Station the right to utilize
approximately 80 acres of land owned by the City for purposes of agricultural
experimentation (hereinafter called the "Lands"); and
WHEREAS, the Original Agreement has expired; and
WHEREAS, the City and the Station desire to amend, renew and extend the
Original Agreement.
NOW, THEREFORE, the parties hereto agree to amend, renew and extend the
Original Agreement as follows:
1. The Original Agreement is hereby renewed and extended for a term of one
(1) year from the date of execution hereof by the City. Further, this
Agreement shall be automatically renewed for successive additional one
(1) year terms unless either party hereto shall provide notice in writing,
delivered no less than thirty (30) days prior to the expiration of the
Original Agreement, to the other party of its desire to terminate the
Original Agreement. For purposes of providing notice of termination, as
described herein, the City Council of the City of Lubbock hereby
delegates said authority to the Managing Director of Public Works of the
City.
2. It is expressly agreed and understood that the application of any
herbicides, insecticides, and/or harvest aids upon the Lands shall be
subject to the prior approval of the City, in the City's sole and absolute
discretion. It is further agreed and understood that Station shall not apply
any fertilizers, of any type or kind, upon the Lands.

3. Exhibit A to the Original Agreement is deleted in its entirety and replaced
with Exhibit "A", attached hereto.
4. To the extent that the Original Agreement conflicts with any provision of
this Renewal, the terms of the Renewal shall absolutely prevail. Except as
otherwise modified herein, all terms and provisions of the Original
Agreement shall remain in full force and effect as originally provided.
