HomeMy WebLinkAboutResolution - 2003-R0075 - Joint Election Resolution With Lubbock County - 02/13/2003Resolution No. 2003-R0075 February 13, 2003 Item No. 56 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute on behalf of the City of Lubbock a Joint Election Resolution with Lubbock County to conduct the May 3, 2003, Special Election to fill the vacancy in Council District No. 6 as a joint election with Lubbock County, which Joint Election Resolution is attached hereto and which shall be a part of this Resolution as if fully copied herein in detail. Vandiver, First Attorney Ddres/JointElectRes03 February 10, 2003 Resolution No. 2003 R0075 February 27, 2003 Item No. 56 JOINT ELECTION AGREEMENT The City of Lubbock and Lubbock County hereby agree to conduct a joint election on May 3, 2003, as both political subdivisions are required to conduct elections on the same day in all or part of the same territory in the election precincts that can be served by common voting places in accordance with Chapter 271, Texas Election Code. The parties hereto agree as follows: THAT common precinct boundaries and voting places shall be utilized insofar as is practical and expedient. 2. THAT a single set of election officers shall be agreed upon and. designated by both parties for the conduct of the election. Such officers shall include those qualified to serve for each individual subdivision. 3. THAT the election shall be administered by Ms. Doris Ruff, County Clerk of Lubbock County, within the limits of Lubbock County with Rebecca Garza, City Secretary of City of Lubbock serving as assistant election officer within the limits of City Council District No. 6 of the City of Lubbock. 4. THAT the preparation of election supplies, contacting of appropriate officials, and all other routine matters for those precincts with voting places within the City of Lubbock shall be the responsibility of Doris Ruff, County Clerk. Rebecca Garza, City Secretary, will provide a set of necessary election forms for each of the City's City Council District No. 6 voting places where a separate form must be used by the two parties to this agreement. 5. THAT each political subdivision shall be responsible for posting its own notices and maintaining records pertaining solely to its own election as custodian of its own records. Each political subdivision also shall be responsible for preparing the ballot for its own election and for conducting a "drawing for place on the ballot," for its own election at a location and time of its own choice. 6. THAT the official canvassing of ballots and announcements of results shall be done individually by each governing body, and the City of Lubbock shall issue its own certificate of election to the candidate elected in its election. 7. THAT in all precincts where there are voters residing outside the jurisdiction of one of the political subdivisions, but inside the other political subdivision, such voters shall be given ballots containing only the names of those candidates for whom they are qualified to vote. THAT separate ballots and ballot boxes shall be used for this election and that the sealed ballot box procedure established by Subchapter C, Chapter 127, Texas Election Code, shall be used for this election. 9. THAT each party will conduct its own early voting, and the City Secretary is appointed as early voting clerk for the City of Lubbock and the County Clerk is appointed as early voting clerk for Lubbock County. 10. THAT each entity shall pay its proportionate share of the common costs attributable to the joint election activities necessary for the conduct of the joint election. In the event that either party does not conduct an election on May 3, 2003, such party shall be liable only for such joint expenses as are incurred prior to cancellation of its election. This Agreement is executed this 13th day of February 2003, and shall become effective on said date of execution.
