Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Casner Natural Resources Attorney RKC:cp Ccdocs/COL-LubbockCounty-brterlocal.Res February 27, 2002 STATE OF TEXAS COUNTY OF LUBBOCK INTERLOCAL AGREEMENT Resolution No. 2002—R0242 June 26, 2002 Item No. 24 This Agreement is made and entered into by and between the County of Lubbock, Texas, acting by and through its duly authorized representative, the Commissioners Court of Lubbock County, Texas, Judge Tom Head presiding and the City of Lubbock, Texas, acting by and through the City Council of the City of Lubbock. WHEREAS, Lubbock County, Texas has enacted an ORDER ADOPTING RULES OF LUBBOCK COUNTY, TEXAS FOR ON-SITE SEWAGE FACILITIES; and WHEREAS, a person in Lubbock County must hold a permit and an approved plan to construct, alter, repair, extend, or operate an on-site sewage disposal system; and WHEREAS, an on-site sewage disposal system in Lubbock County may not be used unless it is inspected by the Texas Natural Resource Conservation Commission (TNRCC) or by Lubbock County through its Health and Environmental Officer; and WHEREAS, this Order applies to all areas in Lubbock County except for areas regulated under existing Rules and areas within incorporated cities; and WHEREAS, the parties to this Agreement desire that the Order apply to the City of Lubbock, Texas; NOW THEREFORE, the parties agrees as follows: I. Lubbock County, through its Health and Environmental Officer shall provide on- site sewage inspection for the City of Lubbock in accordance with the ORDER ADOPTING RULES OF LUBBOCK COUNTY, TEXAS FOR ON-SITE SEWAGE FACILITIES. II. The citizens of the City of Lubbock shall be charged for on-site sewage inspections, in conjunction with obtaining a permit, at the standard rate for all citizens of Lubbock County, Texas, not to exceed the rate set by the Texas Natural Resource Conservation Commission. This Agreement is renewable annually, unless terminated by thirty (30) day written notice by either party. IV. Each party hereto paying for the performance of governmental functions or services, if any, must make payments from current revenues available to the paying party. V. This Agreement contains the entire agreement of the parties with respect to the matters covered herein. No other agreements, statement, or promise made by any party, which is not included in this Agreement, shall be binding or valid. EXECUTED in duplicate this 26th day of June , 2002.
