RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement by
and between the City of Lubbock and the County of Lubbock, Texas for computer aided
dispatch system. Said Agreement is attached hereto and incorporated in this Resolution
as if fully set forth herein and shall be included in the minutes of the Council.
Passed by the City Council this 25th day of April , 2002.

COUNTY OF LUBBOCK §
INTERLOCAL AGREEMENT FOR COMPUTER AIDED DISPATCH SYSTEM
THIS AGREEMENT is made and entered into pursuant to the Interlocal
Cooperation Act, Chapter 791 of the Government Code, by and between the CITY OF
LUBBOCK, TEXAS, hereinafter called the "City," and the COUNTY OF LUBBOCK,
TEXAS, hereinafter called the "County".
WITNESSETH
WHEREAS, the governing bodies of the above-named entities, both being
political subdivisions of the State of Texas, desire to secure the benefits of a common
Computer Aided Dispatch System, hereinafter known as CAD, to receive citizen calls,
dispatch police units in response to those calls, and maintain records of such activities;
WHEREAS, the City has purchased an additional license from the company
which provides the CAD System software and which authorized the City to allow the
County to also utilize the City's CAD System; and
WHEREAS, the County desires to utilize the City's CAD System because it
would benefit County residents, and be less costly and more efficient than other
alternatives; and
WHEREAS, the City desires to contract with the County for the use of the City's
CAD System because it would benefit citizens of City since they are also residents of the
County:
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
The City, for and in consideration of the covenants, conditions, agreements and
stipulations expressed herein, does agree to furnish to the Subscriber services as follows:
1. The City hereby grants to the County the agency license purchased by the
City to utilize the CAD System software for the purpose of receiving
citizen calls, dispatching County personnel in response to those calls, and
maintaining records of those activities.
2. The term of this agreement shall be for one (1) year from the date of
execution by the City's Mayor and shall be automatically renewable
annually; provided, however, that either the City or the County may

terminate this agreement with or without cause upon ninety (90) days
written notice to the other party.
3. The County will pay all costs incurred in connection with the purchase and
maintenance of any computer hardware to enable the County to utilize the
CAD System, as well as the cost of any additional software deemed
necessary by the County to utilize the CAD System. The County shall
also be responsible for the incremental maintenance expenses as charged
by the vendor for the additional agency. This cost will be identified upon
receipt of the vendor's annual maintenance contract. Payment should be
made within ninety (90) days of receipt of this notice.
4. The computers being used by the County for dispatching must be
dedicated to CAD and will not be used for any other purpose.
5. The City will train five (5) individuals selected by the County to train
other County employees to utilize the CAD System software. Additional
training may be requested by County during the term of this agreement
and will be arranged as determined by the parties. The County shall be
solely responsible for training its employees to use the computer hardware
and necessary operating system software for the CAD System to be
operational.
6. During the period of this agreement, the City will cooperate with the
County to expand the City's GEO file to include addresses in the County,
but which are outside the City limits. The County is responsible for the
initial update of the GEO file to include County addresses. The City shall
be responsible for on-going maintenance of the GEO file; however, after
the initial upload, the County shall be responsible for notifying the City of
any additions or changes to the file. A procedure for updating the GEO
file shall be established.
7. The City shall be responsible for the CAD System security.
8. The County shall be solely responsible for the establishment and
maintenance of the communications network from the City's computer
room to the County's dispatch computers.
9. This Agreement may be amended in writing by mutual agreement between
the parties hereto.
10. This Agreement may not be assigned by the County except with the
written consent of the City.

12. The parties shall be responsible for their own respective claims, actions,
suits, charges and judgments whatsoever that arise out of their respective
performance or nonperformance of the subject matter called for under this
Agreement.
13. Each parry paying for the performance of the governmental functions or
services must make those payments from current revenues available to the
paying party.
