HomeMy WebLinkAboutResolution - 2002-R0151 - Interlocal Cooperative Agreement - West Texas Centers For Mental Retardation - 04/25/2002Resolution No. 2002-RO151 April 25, 2002 Item No. 40 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, an Amendment No. 1 to the Interlocal Cooperative Agreement dated April 22, 1999, by and between West Texas Centers for Mental Health and Mental Retardation and the City of Lubbock, and all related documents. Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council this 25th day of April , 2002. 1 WINDY SI ON MAYOR ATTEST: A:��- -C -c- -, �� Reb cca Garza City Secretary APPROVED AS TO CONTENT: Tarf Ellerbrook' Managing Director of Water Utilities APPROVED AS TO FORM: William de Haas Contract Manager/Attorney dh/ccdocs/Mental Health & Retardation Amendment No. 1 April 12, 2002 Resolution No. 2002-RO151 Apirl 25, 2002 Item No. 40 AMENDMENT #1 to INTERLOCAL COOPERATIVE AGREEMENT BY AND BETWEEN WEST TEXAS CENTERS FOR MENTAL HEALTH MENTAL RETARDATION AND THE CITY OF LUBBBOCK This amendment to the Interlocal Cooperative Agreement, ("Original Agreement') dated April 22, 1999, between the City of Lubbock ("City") and West Texas Centers for Mental Health Mental Retardation ("WTCHMHR") for trash and litter collection, is made and entered between the parties April 11, 2002, ("Effective Date"). WHEREAS, City entered into an Agreement with West Texas Centers for Mental Health Mental Retardation, dated April 22, 1999 for trash and litter collection, and WHEREAS, both parties desire to amend the Agreement; and NOW THEREFORE, for and in consideration of the mutual covenants herein, the parties agree to amend the Agreement as follows: Article I A 3 is deleted and replaced with the following: "The total cost of this Agreement shall not exceed Nine Thousand Seven Hundred Seventy-five dollars and no/100 dollars ($9,775.00)." 2. The word, "Locknane" in Article I A 4 is deleted and replaced with, "Selby." 3. Article I B 6 is amended to add the following sentence: "Workers will wear bright orange safety vests at all times." 4. Article I B 7 is deleted and replaced with the following: "A total of one hundred fifteen (115) cycles shall be performed by WTCMHMR annually according to the following schedule: two (2) cycles per week from March 1 through April 30, three (3) cycles per week from May 1 through October 31 performed on Thursdays, Saturdays and Mondays only, and one (1) cycle per week from November 1 through February 28."
