HomeMy WebLinkAboutResolution - 2001-R0269 - Contract For Relocation Assitance Services - Pinnacle Consulting - 06/26/2001Resolution No. 2001-RO269 June 26, 2001 Item No. 42 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a Contract for Relocation Assistance Services, by and between the City of Lubbock and Pinnacle Consulting and Management Group, Inc., and related documents. Said Contract is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Ir J ATTEST: &U�-� Rebecca Garza City Secretary APPROVED AS TO CONTENT: Ed Bucy Right -of -Way Agent APPROVED AS TO FORM: William de Haas Contract Manager/Attorney Dh/Ccdocs/PinnacIeConsultin -and ManagementGroup.res June 5, 2001 Resolution No. 2001-RO269 June 26, 2001 Item No. 42 AGREEMENT TO PROVIDE PROFESSIONAL SERVICES This Agreement entered into this 26th day of June, 2001, by and between the City of Lubbock, Texas (hereinafter referred to as the "City") and Pinnacle Consulting Management Group, Inc., (hereinafter referred to as "Pinnacle"), an Oklahoma corporation authorized to do business in the State of Texas, for the purpose of providing the City with relocation assistance services associated with the Regis Street Green Belt Park from 1-27 Eastward to North Magnolia Avenue project (hereinafter referred to as "Project"). WHEREAS, the City has solicited proposals from qualified firms and based on the proposals received, has selected Pinnacle to provide the services set forth below in Paragraph B. and WHEREAS, Pinnacle desires to contract with the City to provide the services set forth below in Paragraph B, the parties agree to the following: A. The City agrees to the following: Provide acceptable appraisal reports setting forth the value of the property interest to be acquired. 2. Provide funding for the relocation assistance entitlements. 3. Compensate Pinnacle based on the following fee schedule: a. Total relocation fee shall be $1,900 per parcel. Based on an anticipated maximum of fifteen (15) displacements, the total fee shall not exceed $32,300.00. b. The $1,900 fee per displacee shall be due Pinnacle upon receipt of an invoice evidencing the following milestone completions: 10% ($190.00)- Upon completion of the initial interview and explanation of overall relocation program. 30% ($570.00)- Upon delivery to the displacee of their supplemental housing entitlement offer for the residential occupant. For the business and non-profit organization, this milestone will be reached upon delivery of the notice of relocation eligibility. 50% ($950.00)- Upon payment of the supplemental housing entitlement to the residential displacee. For the business and non-profit organization, Agreement To Provide Professional Services, City of Lubbock & Pinnacle this milestone will be reached upon payment of moving entitlement. 10% ($190.00)- Upon submittal to the City of the final file at the completion of the relocation assistance. c. If the anticipated number of displacements increase, the $1,900 fee and the above payment schedule will apply. B. Pinnacle agrees to the following: 1. Provide the City with project personnel as set forth in the Proposal submitted on May 29, 2001, which is made a part of this Agreement. 2. Provide the requested services in accordance with the Scope of Work as set from in paragraph II. 2. "Scope of Work" of the RFP #137-01/1-F, Relocation Assistance Service issued by the City on May 10, 2001, which is make a part of this Agreement and is attached as Exhibit "A". 3. To comply with others terms and conditions as set forth in the Request for Proposal RFP #137-01/1-F, Relocation Assistance Service issued by the City on May 10, 2001. 4. To submit an invoice to the City on a monthly basis for compensation for services rendered as set forth in Paragraph A.3.b. 5. To complete all relocation assistance services on or before March 31, 2002. This Agreement constitutes the full understanding by and between the parties and may only be amended in writing to the satisfaction of both parties. City reserves the. right to adjust the parcel amount if necessary. b) Time Period to complete the relocation work: July 1, 2001 — March 31, 2002 (approximate). c) Follow the Federal Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and all State of Texas (TxDot) Relocation Guidelines. d) Notify all property owners and potential displacees of eligibility for relocation assistance and provide them with a relocation assistance brochure at time of initial contact. City will provide brochures to provider. If possible, advise displacee of preliminary relocation benefits at this time. e) Contact and provide relocation assistance to property owners and tenants affected by acquisition of right of way and complete appropriate forms for all displacees. f) Locate, evaluate, and maintain files on comparable available housing and complete appropriate forms. g) Calculate replacement housing supplement benefits if applicable and record data on the appropriate forms. h) Compute and submit requests for relocation housing/rental supplement to the City on appropriate City form with photos attached. i) Provide 90 -day notice to vacate simultaneous with the delivery of relocation benefits package. j) Sixty days later if displacees have not vacated and if the parcel has been acquired, issue a 30 - day letter. k) Notify City Right of Way office immediately if displacee does not move after 30 -day notice expires. 1) Perform a decent, safe and sanitary inspection of the replacement housing in accordance with Right of Way and TxDot policy. m) Prepare moving plan with appropriate photos and sketches along with inventory of personal property to be moved for non-residential moves. n) Request moving estimates from moving companies as needed. The City will provide list and advise. o) Coordinate moves with displace homeowners, business owners, and tenants and with moving companies in accordance with the City and TxDot procedures. p) Maintain relocation contact logs. q) Attend closing on replacement property if request by any party involved, and assure supplemental payment is properly distributed. r) Process and compute increased interest payments as required. s) Relocation agent(s) shall be available for any appeals or hearings. t) Prepare all relocation payment claim submissions for all displacees on each parcel. u) After completion of services, and the City is audited, successful proposer will be present to answer questions and help obtain additional material if needed. v) All parcels are adjacent to each other, owners live in 12 houses, 3 are rental units, 1 business and 1 church. w) City will provide an office desk, typewriter, and copy machine. A secretary will not be provided. x) Supply proposal of services with bid. y) Several of the property owners are Hispanic and will require that either the relocation person must be able to speak Spanish or have an interpreter available when needed.
