HomeMy WebLinkAboutResolution - 2001-R0140 - Acquisition Of Land - Charles Shannon - 04/26/2001Resolution No. 2001-R 0140 April 26, 2001 Item No. 19 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for a Lubbock International Airport Railroad Spur Track; and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the tract of land further described in Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the owner of said tract, being Charles Ronnie Shannon BE offered through the Right -of -Way Department of the City of Lubbock, the amount of $2,270.00 which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title. METES AND BOUNDS DESCRIPTION of a 0.0304 acre portion of a proposed railroad easement located in the Northwest Quarter of Section 38, Block D, Lubbock County, Texas, being a portion of that tract conveyed to Charles Ronnie Shannon by deed recorded in Volume 2843, Page 323, Real Property Records of Lubbock Canty, Texas, said 0.0304 acre tract being further described as follows: BEGINNING at a concrete right-of-way mariner at the intersection of the East line of the BNSF Railroad right-of-way and the West right-of-way line of a paved county road (Old US Highway No. 87) which bears N. 88°33'49" W. a distance of 5211.49 feet and N. 01'26'11" E. a distance of 3452.15 feet from the Southeast corner of said Section 38; THENCE N. 01'36'01" E., along said railroad right-of-way line, a distance of 334.92 feet to a set 1/2" iron rod with cap; t THENCE Southeasterly along a curve to the left, said curve having a radius of 1089.42 feet, a central angle of 4'25'16", a chord distance of 84.04 feet, and a chord bearing of S. 01'21'24" E. to a 1R" iron rod with cap set for a point of tangency; THENCE S. 03'34'02" E. a distance of 72.11 feet to a In" iron rod with cap set in the East line of said Shannon tract and the West right-of-way line of said county road;- THENCE oad; THENCE Southwesterly along the East line of said Shannon tract and said West right -of --way line, along a curve to the left said curve having a radius of 1482.39 feet, a central angle of 6'56'31 ", a chord distance of 179.50 feet, and a chord bearing of S. 05'03'35" W. to the Point of Beginning.
