RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, an Interlocal Agreement, by
and between the City of Lubbock and Texas Tech University for the University
Streetscape Project, and all related documents. Said Agreement is attached hereto and
incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.
Passed by the City Council this 12th day of April , 20 01.

INTERLOCAL AGREEMENT
THIS INTERLOCAL AGREEMENT is entered into this 12th day of
April , 2001 by and between the City of Lubbock, Texas (the "City") and
Texas Tech University ("TTU").
RECITALS
WHEREAS, the City desires to apply for a Texas Department of Transportation
("TxDOT") Statewide Enhancement Program for the "Gateway" Corridor Project for a
section of University Avenue that is north of 4th Street (the "City's Project"); and
WHEREAS, TTU desires to apply for a TxDOT Statewide Enhancement Program
for the "Gateway" Streetscape Project for a section of 19" Street that is west of
University ("TTU's Project"); and
WHEREAS, the Project will beautify University Avenue and 19th Street, creating
attractive entrances into the City and Texas Tech University; and
WHEREAS, the City and Texas Tech University desire to improve pedestrian
access throughout the project area and to connect the campus to the Canyon Lakes Trail
System; and
WHEREAS, the connection of adjacent disadvantaged neighborhoods to retail
shopping, the Texas Tech Campus and the Canyon Lakes Trail System is beneficial to
both the University and the City; and
WHEREAS, such improved access is critical to the revitalization of residential
and commercial areas around the University and adjacent to the Marsha Sharp Freeway;
and
WHEREAS, both parties are committed to both above-described Projects and
desire to facilitate both said Projects;
NOW THEREFORE, the parties do hereby agree as follows:
1. The City agrees to pay to TTU a total of one-half (1/2) of the total required match
for TTU's Project if TTU's application is accepted by TxDOT.
2. TTU agrees to pay to the City a total of one-half (1/2) of the total required match
for the City's Project if the City's application is accepted by TxDOT.
3. In the event one of the projects is not accepted by TxDOT, the party whose
Project is accepted (the "Accepted Party") agrees to return funds under paragraphs 1 and
2 above to the party whose Project is not accepted (the "Non -accepted Party").
4. The parties agree hereto that all payments made pursuant to this Agreement must
be made from current revenues available to each respective party.
5. The parties agree to comply with all applicable federal, state and local laws and
regulations governing the funds provided under this Agreement.
