HomeMy WebLinkAboutResolution - 2001-R0049 - Overhead Powerline Easement For East-West Freeway Railroad Project - 02/22/2001Resolution No. 2001-R0049 February 22, 2001 Item No. 18 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal and public use and purposes, to -wit: for the East-West Freeway Railroad Relocation Project, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of land as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the overhead powerline easement to the following described parcel of land located in Lubbock County, Texas be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: PARCEL NO. OWNER'S NAME 1RR IE (2) H.A. Sessions AMOUNT �" 11 SECTION 2. THAT the above-described overhead powerline easement whose acquisition is herein authorized is more particularly described in exhibits attached to this Resolution and incorporated herein as part of this Resolution. SECTION 3. THAT the owner of the above-described overhead powerline easement BE offered through the Right -of -Way Department of the City of Lubbock the amount hereinabove indicated for this respective parcel(s), which is the amount appraised as the value and total damages for the granting of a permanent overhead powerline easement, including all legal obligations attached thereto, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the easement title to any or all such parcels as hereinabove described for public purposes and municipal purposes. Passed by the City Council this 22nd day of February 2001. BEGINNING at a point which bears N. 87° 38' 25" W a distance of approx. 331.72 ft. and S 2° 22' 15" W a distance of approx. 2208.59 ft. from the Northeast corner of Section 35 (Common section corner of Sections 35, 36, 37, & 38 Block A -K), Lubbock County, Texas. Same point also lies on the existing North R.O.W. line of "West Texas & Lubbock Railroad" and the South boundary line of Tract Ten (10) Lowery Subdivision. THENCE N 2° 29' 00" E a distance of approx. 516.40 ft. to a point which is also a proposed point of curvature for proposed railroad R.O.W. (Parcel 1RR1) to be dedicated by separate instrument. THENCE N 2° 29' 00" E along the proposed East R.O.W. line of proposed railroad R.O.W. (Parcel 1RR1) a distance of 3144.05 ft. to a point which is also a proposed point of curvature for proposed railroad R.O.W. (Parcel 1RR1). THENCE N 2° 29' 00" E a distance of approx. 779.75 ft. to a point. Same point also lies on the existing South R.O.W. line of "West Texas & Lubbock Railroad", herein called The Lehman Branch of said Railroad and the North boundary line of Tract Ten (10) Lowery Subdivision. THENCE S 69° 45' 03" E along the existing South R.O.W. line of "West Texas & Lubbock Railroad" Lehman Branch, a distance of approx. 10.50 ft. to a point. THENCE S 2° 29' 00" W a distance of approx. 4429.68 ft. to a point. Same point also lies on the existing North R.O.W. line of "West Texas & Lubbock Railroad" and the South boundary line of Tract Ten (10) Lowery Subdivision. THENCE S 56° 17' 50" W along the North R.O.W. line of "West Texas & Lubbock Railroad" a distance of approx. 12.39 ft. to the point of BEGINNING.
