HomeMy WebLinkAboutResolution - 2008-R0451 - Cooperative Working Agreement (LPD, Lubbock County Sherrif, District Attorney) - 11/20/2008Resolution No. 2008-80451 November 20, 2008 Item No. 5.17 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Police Chief of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Cooperative Working Agreement between the City of Lubbock's Police Department, the Lubbock District Attorney's Office, the Lubbock County Sheriffs Department, the Lubbock Rape Crisis Center, The Forensic Nurse Staffing of West Texas with Covenant Health Systems, University Medical Center and Texas Tech University Health Sciences Center C.A.R.E., and the Children's Advocacy Center. Said agreement is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. The Lubbock District Attorney's Office agrees to: ■ Designate a liaison for the Sexual Assault Response Team (SART); ■ Use Sexual Assault Nurse Examiners (SANEs) as witnesses during sexual assault trials; ■ Provide reasonable notification of upcoming trials to the SANE who will be called to testify; ■ Meet with the SANE prior to trial to review the case; and ■ Maintain communication and contact with the SART. The Lubbock County Sheriffs Department and the City of Lubbock Police Department agree to: ■ Designate a liaison for the SART; ■ Refer all adult and acute child cases of sexual assault to the SANE; ■ Follow established protocol to notify the SANE that a sexual assault survivor is being transported to the hospital; ■ Provide a case or incident report number; ■ Follow law enforcement established protocol regarding evidence collection and storage. The Lubbock Rape Crisis Center agrees to: ■ Designate a liaison for the hospital to contact; ■ Designate a liaison for the SART; ■ Maintain a thirty minute response from the time of call received to time advocate arrives in emergency room; ■ Designate a liaison for the SANE to contact; ■ Refer all adult and acute child cases of sexual assault to the SANE; ■ Follow established protocol with University Medical Center, Covenant Health Systems and Texas Tech University Health Sciences Center C.A.R.E. Center; and ■ Be available for survivors of all ages, their family members and friends. ■ Explain the purpose of the Children's Advocacy's Center of the South Plains in cases where the victim is a child. The Forensic Nurse Staffing of West Texas with Covenant Health Systems, University Medical Center and Texas Tech University Health Sciences Center C.A.R.E. Center agree to: • Designate SART liaisons and SANE Coordinators; ■ Maintain a thirty minute response from the time of call received to time the SANE arrives in the emergency room with the C.A.R.E. Center to maintain routine working hours; Children with acute sexual assault will be seen in the emergency departments (ED). Children who make a delayed outcry >96 hours from the time of the assault will be referred to the CARE center during routine working hours. ■ Report to Children's Protective Services, a Division of the Texas Department of Family and Protective Services, all instances where there is cause to believe that a child's physical or mental health or welfare has been, or may adversely, be affected by abuse or neglected in accordance with the Texas Family Code, Section 261.101. The Hotline number is 1-800-254-5400. ■ Notify Lubbock Rape Crisis Center that a survivor is being transported or has arrived at the emergency room; ■ Provide Lubbock Rape Crisis Center the opportunity to establish a relationship with the survivor(s), if survivor agrees. This includes survivors of all ages, their family members, and friends; ■ Provide consistency in the sexual assault examination of survivors; ■ Provide consistency in the evidence collection from perpetrators; ■ Maintain chain of forensic evidence and hand off to a designated law enforcement agent; ■ Properly prepare for upcoming hearings; ■ Meet with the Lubbock County Criminal District Attorney's Office to review the case; ■ Maintain contact with the Lubbock County Criminal District Attorney's Office; and notify the Lubbock County Criminal District Attorney's Office of address and /or telephone number changes; and ■ Provide sexual assault evidence collection (rape) kits. The Children's Advocacy Center of the South Plains agrees to: • Provides forensic interviews at the Children's Advocacy Center for all children under the age of 14. Children between the ages of 14 and 17 will be encouraged to come to the center for a forensic interview; • Provide all support and advocacy services to children aged 17 and younger and their non -offending family members; • Coordinate and facilitate all Multi -disciplinary Team efforts; • Provide follow up and case tracking.
