RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, a Quitclaim Deed in favor of
Caprock Commerce Corporation, and related documents. Said Deed is attached hereto
and incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.
Passed by the City Council this 22nd day of May rJ 2003.

QUITCLAIM DEED
THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK
THAT the CITY OF LUBBOCK, a Home Rule Municipality in the County of Lubbock,
State of Texas, hereinafter called "GRANTOR," for and in consideration of the sum of TEN
AND NO/100 DOLLARS ($10.00) and other good and valuable consideration to GRANTOR in
hand paid by CAPROCK COMMERCE CORPORATION, hereinafter called "GRANTEE,"
the receipt of which is hereby acknowledged, does hereby by these presents ABANDON,
DISCLAIM, RELEASE and FOREVER QUITCLAIM unto the said GRANTEE, all of
GRANTOR'S rights, title and interest in and to that certain tract or parcel of land lying and being
situated in the County of Lubbock, State of Texas, described as follows, in the attached Exhibit
"A
TO HAVE AND TO HOLD the same premises together with all and singular the rights,
privileges and appurtenances thereto in any manner belonging unto the said GRANTEE, their
heirs and assigns forever, so that neither the GRANTOR, its successors or assigns, nor any
persons claiming under GRANTOR shall at any time hereafter have, claim or demand any right
to the title to the aforesaid premises or appurtenances or any part thereof.

METES AND BOUNDS DESCRIPTION for a portion of North Avenue "Q" to be closed located in Section 19,
Block A, Lubbock County, Texas, being further described as follows:
BEGINNING at a'/2" iron rod with cap set at the original Northwest corner of Lot 30, Norwood Subdivision of
Block 61, Roberts and McWhorter Addition to the City of Lubbock, Lubbock County, Texas, according to the
map, plat, and/or dedication deed thereof recorded in Volume 282, Page 629, Deed Records of Lubbock
County, Texas, same being a point in the South right-of-way line of Auburn Street;
THENCE South, along the West lines of Lots 20 through 30 of said Norwood Subdivision, a distance of 412.07
feet to a 3/4" iron pipe found in the West right-of-way line of North Avenue "Q" Drive as recorded in Volume
553, Page 416, Deed Records of Lubbock County, Texas;
THENCE S. 16052'50" W. a distance of 101.88 feet to a'/2" iron rod with cap set at a point of intersection in the
West right-of-way line of North Avenue "Q" as recorded in Volume 282, Page 629, Deed Records of Lubbock
County, Texas, same being in the East right-of-way line of the P & SF Railroad;
THENCE Northwesterly, along the West right-of-way line of said North Avenue "Q" and the East right-of-way
line of said P & SF Railroad, around a curve to the right, said curve having a radius of 714.00 feet, a central
angle of 0715'38", tangent lengths of 45.30 feet, a chord bearing of N.03043'56"W., and a chord distance of
90.42 feet to a 1/2" iron rod with cap set at a point of tangency;
THENCE N. 00010'00" W., along the West right-of-way line of said North Avenue "Q" and the East right-of-way
line of said P & SF Railroad, a distance of 419.11 feet to a 1/2" iron rod with cap set in the South right-of-way
line of Auburn Street;
THENCE East, along the South right-of-way line of Auburn Street, a distance of 36.72 feet to the Point of
Beginning.
