RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for cemetery expansion and the City
Council of said City finds it in the public interest and for public purposes and municipal
purposes to proceed with the acquisition of lands as needed for such purposes as
aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the tracts of land further described in
Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes as
set forth in the preamble hereof.
SECTION 2. THAT the owners of said tracts, being THE WILKERSON
COMPANY, a Texas general partnership composed of GORDON MARK
WILKERSON, DAVID COLLINS WILKERSON, RAY HANKINS WILKERSON,
SARAH RUTH WILKERSON SCOTT and WILKERSON INVESTMENT CO., a Texas
general partnership composed of GORDON MARK WILKERSON, DAVID COLLINS
WILKERSON, RAY HANKINS WILKERSON and SARAH RUTH WILKERSON
SCOTT, BE offered through the Right -of -Way Department of the City of Lubbock the
amount of $6,400.00 which is the amount appraised as the value and total damages for
the fee simple title and acquisition of said real estate purposes herein stated, and unless
accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and
instructed to institute condemnation (eminent domain) proceedings to acquire the fee
simple title.

TRACT II: LOT TWO (2), BLOCK ELEVEN (11), PHYLLIS WHEATLEY SUBDIVISION, AN ADDITION TO THE
CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, according to the Map, Plat and/or Dedication Deed thereof
recorded in Volume 323, Page 314 of the Deed Records of Lubbock County, Texas., ALSO KNOWN AS Lots
6 through 10, Block 11, Phyllis Wheatley Subdivision as shown on the Plat attached to -Volume 342, Page 430
of the Deed Records of Lubbock County, Texas, Save & Except that portion of said Lots 6 through 10, Block 11,
Phyllis Wheatley Subdivision which was conveyed to W. H. Holmes and wife, Mattie Holmes as set forth in
Volume 342, Page 430 of the Deed Records of Lubbock County, Texas, and ALSO KNOWN AS the East 67.4
feet of Lots 6-10, Block 11, being the East 67.4 feet of Block 11, Phyllis Wheatley Subdivision, an Addition to
the City of Lubbock, Lubbock County, Texas, as per those certain Warranty Deeds recorded in Volume 1453,
Page 590; Volume 1453, Page 856 and Volume 1655, Page 339 of the Deed Records of Lubbock County, Texas.

grantee, recorded in Volume 378, Page 373 of the Deed Records of Lubbock County, Texas; and the North 20'
of Lot 5, Block 14, Phyllis Wheatley Subdivision, an Addition to the City of Lubbock, Lubbock County, Texas,
according to the Map, Plat and/or Dedication Deed thereof recorded in Volume 323, Page 314 of the Deed
Records of Lubbock County, Texas.
