HomeMy WebLinkAboutResolution - 2002-R0524 - Resolution Outlining City Councils Legislative Positions And Agenda - 11/21/2002Resolution No. 2002-RO525 November 21, 2002 Item No. 51 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK THAT the City Council of the City of Lubbock hereby adopts the Omnibus Legislative Policy for the 78th State Legislative Session and the 108th United States Congress for the purpose of defining the position of the City of Lubbock. Said Legislative policy is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. Initiate Legislation the City would introduce and push for passage. I-1. Initiate a change in Chapter 615 regarding continued health insurance for a civil servant's surviving spouse and children, in the event that a civil servant is killed in the line of duty. I-2. Initiate legislation to enable Lubbock to market water from Lake Alan Henry to other entities and communities. I-3. Initiate legislation that will strengthen health, safety, and welfare laws to prevent private property owners from encroaching on a City's restrictive easements at Lake Alan Henry. I-4. Initiate legislation to amend Section 31.126 of Parks and Wildlife Code to establish concurrent venue in Lubbock County for offenses occurring on Lake Alan Henry or City of Lubbock owned real property located in Kent County or Garza County. I-5. Initiate legislation to enable the City of Lubbock to regulate the surface of Lake Alan Henry and to charge reasonable fees for recreational use thereof. I-6. Initiate legislation to provide for state remediation of unpermitted solid waste facilities. I-7. Initiate legislation allowing a majority of a municipality's governing body to approve the public inspection and copying of the certified agenda or tape of a closed meeting. I-8. Initiate legislation increasing local option purchasing discretion from 3% to 5%, and expand the local option clause to include contracts for services, as well as goods. I-9. SUPPORT Legislation we expect to be introduced by other entities. S-1. Support legislation to allow cities the same interlocal agreement rights for fires services, which are currently available for police services between governmental entities. S-2. Support simplified statewide liability rules governing interlocal and mutual aid all -hazards response when a state or federal disaster is declared. This would allow all government agencies to respond to the highest level emergencies in their region, without fear of unreasonable liability to its taxpayers. S-3. Initiate an amendment to Section 143.072(d) Subchapter E, Local Government Code to grant a fire fighter or police officer a leave of absence for initial training, annual duty, or recall to active duty in the military guard or reserves. S-4. Initiate legislation to allow a combination of law enforcement and military service credit to qualify for the age exception to take the entrance examination for a civil service position. 3 Resolution No. 2002-RO524 City of Lubbock Legislative Positions in the 78th Texas Legislature November 21, 2002 3. OPPOSE Legislation we expect to be introduced that would have negative implications for the City. 0-1. Oppose any erosion of the City Council's zoning authority, or the addition of costs to cities as a result of down zoning. 0-2. Oppose any erosion of authority of cities to regulate the use of their rights - of —way. 0-3. Oppose any erosion of the authority of cities to regulate the location or siting of manufactured/industrialized housing. 0-4. Oppose laws that would mandate a required college degree as a qualification to become a peace officer. 0-5. Oppose legislation that would alter current requirements for the City to enter into collective bargaining or meet -and -confer procedures with police or fire associations. 0-6. Oppose any weakening of home rule cities' annexation authority. 0
