HomeMy WebLinkAboutResolution - 2002-R0486 - Letter Of Agreement - West TX Municipal Power Agency - 11/14/2002Resolution No. 2002-RO486 November 14, 2002 Item No. 31 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to ratify the City Manager's approval of the West Texas Municipal Power Agency's letter agreement with regard to the City of Lubbock's assumption of custody of the West Texas Municipal Power Agency's documents for purposes of conducting an audit. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. Box 2000 Lubbock, Texas 79457 Re: City of Lubbock Audit of WTMPA Records Relating to JRM#8 Dear Mr. Cass: Resolution No. 2002-R0486 November 14, 2002 Item No. 31 The West Texas Municipal Power Agency C WTMPA") has been requested by the City of Lubbock C'City") to furnish to the City all records concerning the operation of WTMPA. The City has requested for its convenience that WTMPA's original records be transferred to the City Hall. WTMPA is agreeable to this arrangement, provided the City of Lubbock approves the following conditions: The City will transport WTMPA's records to City Hall. The City agrees to secure WTMPA's records. WTMPA's records be covered under the City of Lubbock's valuable documents insurance policy. It is understood that the City does not have a separate, stand-alone, valuable documents policy. However, the City does have an endorsement on their property insurance policy, to which WTMPA is already an additional insured, which provides for up to $100,000 of valuable documents coverage. You will designate a custodian of WTMPA's records during the time the records remain in the City's possession. WTMPA's records will be accessible only to yourself, the City Council, the City Attorney, the City of Lubbock's employees or contract auditors performing the audit, and any attorney or representative of WTMPA or any other member city of WTMPA. No original WTMPA records will be removed from the possession of the City's custodian. WTMPA's records will be returned. to WTMPA by the City immediately following conclusion of the City's examination of the records. The City of Lubbock shall have sole responsibility for any loss, destruction or misuse of WTMPA's records save and except for any loss, destruction or misuse caused by WTMPA or its employees or agents while the documents are housed at City Hall.
