HomeMy WebLinkAboutResolution - 2002-R0475 - Resolution Authorizing City Manager To Respond To Police Services - 10/24/2002Resolution No. 2002-RO475 October 24, 2002 Item No. 53 RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK-, TEXAS, AUTHORIZING THE CITY MANAGER TO RESPOND TO REQUESTS FOR POLICE SERVICES MADE BY OR ON BEHALF OF GOVERNMENTAL ENTITIES AND POLITICAL SUBDIVISIONS OF THE STATE OF TEXAS AND, IN RENDERING SAID SERVICES, UTILIZE THE PERSONNEL AND EQUIPMENT OF THE LUBBOCK POLICE DEPARTMENT OUTSIDE THE CITY LIMITS OF THE CITY OF LUBBOCK, TEXAS. WHEREAS, the City of Lubbock wishes to promote and enhance the safety and security of the citizens of the city as well as those of surrounding communities; and WHEREAS, the Omnibus Crime Control and Safe Streets Act of 1968, as amended, 42 U.S.C. 3711, et seq. and 42 CFR 31, et seq. provide for the payment of benefits to public safety officers killed or permanently disabled while serving in their official capacity; and WHEREAS, the City Council of the City of Lubbock intends that police officers responding, under the direction of the City Manager and Chief of Police, to requests for police services outside the city limits are serving in an official capacity for the City of Lubbock. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION a_. That the City Manager of the City of Lubbock, Texas, acting by and through the Chief of Police, be and is hereby authorized to respond to calls for police service outside the city limits of the City of Lubbock made by or on behalf of governmental entities and political subdivisions of the State of Texas. SECTION 2. That the City Manager and Chief of Police, in providing the response to requests for police service as provided herein, are authorized to utilize personnel and equipment of the Lubbock Police Department. SECTION 3. That officers and employees of the Lubbock Police department responding to requests for police service under the direction of the City Manager and Chief of Police, as provided herein, are serving in their official capacity as officers of the Lubbock Police Department and as employees of the City of Lubbock. SECTION 4. That the City Council of the City of Lubbock hereby authorizes and directs that this resolution take effect immediately from and after it's passage.
