RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Amendment of
Interlocal Contract for Provision of Fire Protection Services between the City of
Lubbock and Lubbock Reese Redevelopment Authority, and any other related
documents. Said Amendment is attached hereto and incorporated in this Resolution as
if fully set forth herein and shall be included in the minutes of the Council.

AMENDMENT
OF
INTERLOCAL CONTRACT FOR PROVISION
OF
FIRE PROTECTION SERVICES
STATE OF TEXAS
COUNTY OF LUBBOCK §
THIS Amendment of Interlocal Contract for Provision of Fire Protection Services
(the "Amendment") is entered into on this 26th day of September , 2002, by and
between the City of Lubbock, Texas (hereinafter referred to as "CITY") and the Lubbock
Reese Redevelopment Authority, acting by and through its duly authorized officer or his
designee (hereinafter referred to as "REESE").
WITNESSETH:
WHEREAS, the CITY and REESE entered into that certain Interlocal Contract
for Provision of Fire Protection Services (the "Original Contract"), on or about January
24, 2002, providing for the provision of fire protection services by the CITY to REESE,
as described therein;
WHEREAS, the Original Contract, as same pertains to the reimbursement
obligation of REESE for the provision of fire protection services by the City, is in need of
amendment to clarify the relative responsibilities of the CITY and REESE; and
WHEREAS, the CITY and REESE now desire to amend the Original Contract as
set forth below.
NOW, THEREFORE, the CITY and REESE amend the Original Contract as follows:
1. Section IV "Payment for Services" is deleted in its entirety and replaced with
the following:

PAYMENT FOR SERVICES
WHEREAS, REESE has agreed to reimburse the CITY for
the provision of these Fire Protection Services, by
providing the City of Lubbock Fire Department with access
to the Reese Fire Station for storage and deployment of fire
suppression equipment as deemed necessary by the
Lubbock Fire Chief or his designee and providing for the
one-time single payment of One Hundred Eighty -Two
Thousand Six Hundred Eight Dollars and Forty -Three
Cents ($182,608.43) for Fire Protection Services to be paid
not later than September 30, 2002 as a fee for establishing
such services. This one time payment represents 19% of
the City of Lubbock's total annual cost of Nine Hundred
Sixty -One Thousand Ninety -Seven Dollars and No/100
Cents ($961,097.00), to provide this fire protection, as
itemized on Exhibit "A", attached hereto. After the
payment of such fee no other charges shall be assessed
REESE during the initial term of this Contract. Payments
and services may be renegotiated by the parties hereto upon
thirty (30) days written notice to the other party prior to
any annual renewal of this Contract. Any payments
required to be made pursuant to this Contract shall be made
from current funds available to the paying party.
2. Exhibit "A" to this Amendment is added as Exhibit "A" to the Original
Contract.
3. Except as expressly amended by this Amendment, the Original Contract
remains in full force and effect as originally provided.
Executed this 26th day of September , 2002, but effective for all purposes
the 26th day of September , 2002.
