HomeMy WebLinkAboutResolution - 2002-R0196 - Supplemental Agreement With Federal Aviation Administration - 05/23/2002Resolution No. 2002-RO196 May 23, 2002 Item No. 29 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Supplemental Agreement No. 1 with the United State of America, represented by the Federal Aviation Administration, amending Lease No. DTFA07-00-L-00760 at the Lubbock International Airport, and all related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Chamales, Supervising Attorney Office Practice Section LC: L/ATTY/Linda/RES-FAA AMENDMENT Resolution No. 2002—R 0196 Nay 23, 2002 Item No. 29 DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION SOUTHWEST REGION FORT WORTH, TEXAS 76193-0054 Lease No. DTFA07-00-L-00760 Flight Standard District Office Lubbock International Airport Lubbock, Texas SUPPLEMENTAL AGREEMENT NO. 1 THIS SUPPLEMENTAL AGREEMENT, made and entered into this 23rd day of may , 2002, by and between CITY OF LUBBOCK, TEXAS, whose address is Lubbock International Airport, Route 3, Box 389, Lubbock, Texas 79401, for itself, its executors, administrators, successors and assigns, hereinafter called the Lessor, and the UNITED STATES OF AMERICA, represented by the Federal Aviation Administration, hereinafter referred to as the Government, WITNESSETH, That: WHEREAS, on May 27, 1999, the parties hereto entered into Lease No. DTFA07-00-L-00760, for the consideration and purpose more particularly stated in said lease; and, WHEREAS, the Lessor has a requirement to alter an office and storage area of the existing leased premises to accommodate the addition of the Silent Wings Museum to the old terminal building; and, WHEREAS, the Lessor agrees to accomplish such alterations at no cost the Government to include the moving and replacing of furniture; and, WHEREAS, the Government agrees to allow the Lessor to perform such alterations as defined in the scope of work and floor plan; and, WHEREAS, the Government and Lessor agree that the total square footage and annual rent for the leased premises are to remain the same and no adjustments required by the minor space alterations. NOW THEREFORE, effective immediately, the parties hereto mutually agree to amend the basic lease, as previously amended in the following particulars only, VIZ: 1. The Lessor agrees to provide required alterations to the facility building space in accordance with the drawing designated Exhibit "A" and the contractor's estimate designated Exhibit `B", to include demolition, floor covering, and the replacement of shelves in the storage room, as attached hereto and made a part hereof. The Lessor also agrees to reroute all cables and Supplemental Agreement No. 1 Lease No. DTFA07-00-L-00760 Flight Standard District Office Lubbock, Texas wiring relating to telephone and data services affected by the alterations, and secure the office and storage area during construction. 2. The Lessor will accomplish said alterations with such diligence, as will ensure completion not later then 21 days from the start of construction. All cost incurred for alterations are to be the responsibility of the Lessor. ALL OTHER TERMS AND CONDITIONS of the basic lease are hereby ratified and except as amended hereinabove shall be and remain the same.
