HomeMy WebLinkAboutResolution - 2001-R0451 - Land Acquisation - Mary Tharp And Nadine Wallace - 10/25/2001Resolution No. 2001-R 0451 October 25, 2001 Item No. 18 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for public park purposes, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to following described parcels of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: Lots 19,20, Block 4, Westacres Addition, to the City of Lubbock, Lubbock County, Texas as shown on the map, plat and/or dedication deed thereof recorded in Volume 409, Page 53, Deeds Records, Lubbock County, Texas. SECTION 2. THAT the owners of above-described parcels of land being Mary Ann Tharp and Marion Nadine Wallace as Successor Co -Trustees of the ARTHUR M. WALLACE and MARION NADINE WALLACE 1979 REVOCABLE LIVING TRUST, dated August 15, 1979, as amended and restated by FIRST AMENDED DECLARATION OF TRUST BY ARTHUR M. WALLACE and MARION NADINE WALLACE, dated November 15, 1985, as amended by FIRST AMENDMENT TO FIRST AMENDED DECLARATION OF TRUST BY ARTHUR M. WALLACE and MARION NADINE WALLACE, dated May 7, 1991, and as amended by SECOND AMENDMENT TO FIRST AMENDED DECLARATION OF TRUST BY ARTHUR M. WALLACE and MARION NADINE WALLACE, dated August 28, 1995, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $1,200.00, which is the amount appraised as the value and total damages for the fee simple title, including all legal obligations attached thereto, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to any or all such parcels as hereinabove described for public purposes and municipal purposes.
