RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock an Amendment to Contract No. 5110517-
6006, between the City of Lubbock and Texas Department of Transportation (TxDOT), for the
purchase of replacement buses. Said Amendment is attached hereto and incorporated in this
Resolution as if fully set forth herein and shall be included in the minutes of the Council.
Passed by the City Council this 13th day of September ,2001.

THIS AMENDMENT TO GRANT AGREEMENT made by and between the state of
Texas acting through the Texas Department of Transportation, hereinafter called the "State," and
City of Lubbock, hereinafter called the "Subrecipient".
WITNESSETH
WHEREAS, on October 1, 2000, a grant agreement was entered into by and between the
above-mentioned parties, which grant agreement provided for the expenditure of funds pursuant to
the provisions of 49 USC §5310 of the Federal Transit Act of 1964, as amended, for a public
transportation project; and,
WHEREAS, the Subrecipient has requested additional federal funds to complete the
project;
NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the parties
hereto agree to amend the above-mentioned grant agreement as follows:
I. Article 3A, page 2, sentence 1 is revised to read: "The maximum amount payable
under this grant agreement without modification is $778,146.00 and toll credits in
the amount of 194537. Exhibit A attached hereto is the revised project budget and
shall replace the budget included with the above mentioned grant agreement.
II. All of the other terms, conditions and provisions of the original grant agreement
shall remain in full force and effect.

SIGNATORY WARRANTY
The undersigned signatory for the Subrecipient hereby represents and warrants that he/she is an
officer of the organization for which he/she has executed this agreement amendment` and that
he/she has full and complete authority to enter into this agreement on behalf of the organization.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents to be executed in
duplicate counterparts.
THE STATE OF TEXAS
Certified as being executed for the purpose and effect of activating and/or carrying out the
orders, established policies, or work programs heretofore approved and authorized by the Texas
Transportation Commission under the authority of Minute Order 108224 and 108199.
