HomeMy WebLinkAboutResolution - 2001-R0299 - Amendment To Lubbock Arts Alliance Agreement - 08/09/2001Resolution No. 2001-R 0299 August 9, 2001 Item No. 3 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Amendment to the April 12, 2001, Agreement by and between the City and the Lubbock Arts Alliance, Inc., and any associated documents, a copy of which Amendment is attached hereto and which shall be spread upon the minutes of this Council and as spread upon the minutes of this Council shall constitute and be a part hereof as if fully copied herein in detail. Vandiver; First Assistant City Attorney Mres/ArtsAmend.res June 20, 2001 AMM j0 11W100110M4WOO��AWA Resolution No. 2001-RO299 August 9, 2001 Item No. 3 AMENDMENT THE STATE OF TEXAS § COUNTY OF LUBBOCK § WHEREAS, the City of Lubbock (hereinafter called "City") and the Lubbock Arts Alliance, Inc., (hereinafter called "Alliance") did heretofore on the 12`'' day of April, 2001, entered into an Agreement with regard to the Alliance's operation of a program to make grants for the encouragement, promotion, improvement and application of the arts within the City of Lubbock; and WHEREAS, it is the desire of the City and the Alliance to amend said Agreement between the City and the Alliance as follows; NOW THEREFORE: WITNESSETH: Section 5 of said Agreement is hereby amended to read as follows: 5. Ten percent (10%) of the Funds may be used by the Alliance to pay the estimated administrative costs of disbursement of the funds. No more than FOURTEEN THOUSAND, SIX HUNDRED SEVENTY-NINE DOLLARS AND 77 CENTS ($14,679.77) may be expended for administrative expenses. The balance of that payment provided by the City shall be deposited pending disbursement to application grantees in an interest bearing account at a federal insured depository of the Alliance's choosing. Only the principal shall be expended on grants. The interest accumulated in Alliance's account may be used by the Alliance this funding year only (2001-2002) to replace lost program revenues as a result of adverse weather issues on two Alliance projects in an amount not to exceed THIRTY THREE THOUSAND AND NINE DOLLARS AND NO CENTS ($33,009.00). This Amendment to the April 12, 2001, Agreement between the City and the Alliance is executed this 9th day of August , 2001.
