RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for the East-West Freeway Railroad
Relocation Project, and the City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of land as needed
for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the improvements on the following described parcel of land
located in Lubbock County, Texas, be acquired for public purposes and municipal
purposes as set forth in the preamble hereof, to -wit:

SECTION 2. THAT the improvements on the above-described parcel of land
whose acquisition is herein authorized is more particularly described as "Exhibit A"
attached to this Resolution and incorporated herein as part of this Resolution.
SECTION 3. THAT the owners of the above-described improvements on the
parcel of land BE offered through the Right -of -Way Department of the City of Lubbock
the amount hereinabove indicated for their respective parcel(s), which is the amount
appraised as the value and total damages for the acquisition of the improvements,
including all legal obligations attached thereto, for the use and benefit of the City of
Lubbock, Texas, for the purposes herein stated.
Passed by the City Council this 6th day of march , 2001.

Being 0.21 hectares (0.51 acres) out of a 138 acre tract of land out of Section 22, Block JS,
E -L.& R.R. RR. Co. Survey, Abstract 862, Lubbock County, Texas, as described in Volume 399,
Page 138 of the Deed Records of Lubbock County, Texas, said tract of land was conveyed by
deed dated March 9, 1950 by Joseph Hodges and wife, Gladys Hodges. to J. A. Hodges & wife,
Helen Hodges recorded in Volume 399, Page 138 of the Deed Records of Lubbock County,
Texas, which said 0.21 hectares (0.51 acres) is more particularly described as follows;
BEGINNING at a %z" Iron Rod with Cap, -set in the West line of a 5.79 acre tract of land
recorded in Volume 4744, Page 335 of the Official Real Property Records of Lubbock County,
Texas and in the proposed South Railroad Right -of -Way line, for the Southeast and beginning
corner of this parcel, whence the Southwest corner of Section 22, Block JS, bears South
02°19'08" West, 340.032 meters ( 1115.59 feet) and North 87°34'32" West, 741.984 meters
(2434.33 feet);
(1) THENCE North 46°43'05" West, along the proposed South Railroad Right -of -Way line,
a distance of 42.678 meters (140.02 feet) to a %z" Iron Rod with Cap, set for a corner of this
parcel;.
(2) THENCE North 52126'34" West, along the proposed South Railroad Right -of -Way line
a distance of 27.611 meters (90.59 feet), to a ''/z" Iron Rod with Cap, set for a Point of Curvature
and a corner of this parcel;

(3) THENCE Northwesterly, along the arc of a curve to the right, and being the proposed
South Railroad Right of Way line, an arc distance of 36.420 meters (119:49 feet), to a %" Iron
Rod with Cap, set for a comer of this parcel, said curve has a radius of 364.517 meters (1195.92
feet) and a chord that bears North 49934'49" West, 36.405 meters (119.44 feet);
(4) THENCE North 46°43'05" West, along the proposed South Railroad Right of Way line,
a distance of 1.175 meters (3.85 feet), to a ''/z" Iron Rod with Cap, set in the Existing Northerly
Right of Way line of U.S. Highway 84, for a corner of this parcel;
(5) THENCE North 44°04'52" West, along the Existing Northerly Right of Way line of U.S.
Highway 84, a distance of 65.117 meters (213.64 feet), to a found concrete highway Right of
Way monument, for a Point of Curvature and a corner of this parcel;
(6) THENCE Northwesterly, along the arc of a curve to the left, and being along the
Existing Northerly Right of Way line of U.S. Highway 84, an arc distance of 82.500 meters
(270.67 feet), to a V2" -Iron Rod with Cap, set in the Northerly Right of Way line of U.S. Highway
84, for the most Northerly corner of this parcel, said curve has a radius of 1761.620 meters
(5779.58 feet) and a chord that bears North 45°25'59" West, 82.493 meters (270.65 feet);
(7) THENCE South 46'22'17" East, along the Existing Right of Way line of the B.N. & S.F.

West line said 5.79 acre tract of land, a distance of 7.955 meters (26.10 feet) to the point of
