HomeMy WebLinkAboutResolution - 2001-R0012 - Slope Easement To Be Acquired For Land Purchase - 01/25/2001Resolution No. 2001-R0012 January 25, 2001 Item No. 28 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for Milwaukee Avenue widening project from 4' Street to 34"' Street and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title and slope easement to the tracts of land further described in Exhibit "A" and Exhibit "B" attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the owners of said tracts, being Bobbie Jean Wilson; J.R. Austin and Sandra Austin, husband and wife; Douglas J. Corley and Sammie P. Corley, Trustees, under the Douglas J. and Sammie P. Corley Living Trust, dated October 1, 1991, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $42,400.00 which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate purposes and slope easement herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title and slope easement. Corley Living Trust EXHIBIT "A" Being 0.25 acres of land out of a 14.80 acre tract of land located in Section 10, Block JS, E. L. & R. R. R.R. Co. Survey, Lubbock County, Texas, said tract of land was conveyed by deed dated September 30, 1992 by Douglas J. Corley and wife, Sammie P. Corley to Douglas J. and Sammie P.
