Said Amendment No. 5 is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. TX 00103 TASK 5 - Aircraft Rescue and Firefighting (ARFF) Training Facility (Construction Phase Services) AMENDMENT NO. FIVE (5) TO THE AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ENGINEER FOR PROFESSIONAL SERVICES NOVEMBER 30, 2000 TASK 5 Aircraft Rescue and Firefighting (ARFF) Training Facility (Construction Phase Services) This AMENDMENT NO. FIVE (5), dated November 30, 2000, is made a part of the Agreement for Professional Services dated May 22, 1997, between the City of Lubbock, Texas, the OWNER, and Delta Airport Consultants, Inc., the ENGINEER, for work at Lubbock International Airport, Lubbock, Texas. The following revisions and/or additions are made to the original Agreement: ADD the following paragraphs to Article 6: 6.7 Task 5 - Construction Phase - It is understood that the ENGINEER will proceed with Task 5 Construction Phase Services after a Notice -to -Proceed from the Owner. The contractor's schedule for construction is 220 days from the Notice -to -Proceed. Delta's work will be completed within 90 calendar days after final acceptance. ADD the following paragraphs to Article 7: 7.18 Task 5 - Aircraft Rescue and Firefighting Training Facility - Construction Phase Services - Construction administration, construction observation workhours, resident project representative services, direct non -salary expenses, and subcontracted Q/A testing mechanical, architectural and record drawing survey services will be compensated on a unit price plus fixed fee basis. Compensation for these services shall be limited to an initial budget amount of $408,978 unless written authorization has been received from the Owner. Please provide an hourly fee estimate and direct costs for the scope of work presented below. SCOPE 1. Provide Mechanical/Processing and Architectural Construction Phase Services in order to support the design completed by CH2M-Hill for this project. This should include but not be limited to the following: A. Attendance at the pre -construction meeting B. Review of pertinent shop drawing submittals C. Material Submittal and Review D. Three site visits including final inspection E. Special inspections or other necessary inspections in accordance with the appropriate Texas building codes. E. Sealed Record Drawings F. Other items of scope work as deemed appropriate (Please provide a listing of these items in your proposal) 2. If accepted your proposal shall serve as a basis for a not -to -exceed fee which will be incorporated into the existing agreement between Delta Airport Consultants and CH2M- Hill dated April 19, 2000. 4. Since this project is also anticipated to be federally funded, your firm shall abide by the Title VI Assurances attached. 5. As soon as your services are complete, your firm should invoice Delta Airport Consultants, Inc. All invoices shall be received by Delta by the 25th of each month. Your invoice will then be included with the next Delta invoice. Payment for your services will be forwarded within fourteen (14) days upon receipt of payment from the Owner. 6. As a portion of the project is located within the active Aircraft Operational Area (AOA), all employees shall coordinate an escort to the site through Delta Airport Consultants. Delta will be providing materials testing services associated with the foundation and concrete design. Please provide a list of any additional testing necessary. Delta is requesting your proposal on or before December 15, 2000. It is anticipated that Notice -to -Proceed for your work will be given in the spring of 2001. The proposal should be based on the following scope of work: SCOPE 1. The acceptance testing services shall consist of the testing of approximately: a. 9,400 tons of R-247 TXDOT Type A, Garde 2 Flexible Base b. 400 square yards of miscellaneous concrete (sidewalk, curb & gutter, paved ditch, etc.) C. 5,000 square yards of P-152 earthwork, subgrade, utility backfill, etc. d. Acceptance testing for building foundation in accordance with local and state building code requirements. e. Acceptance testing for all building construction in accordance with local and state building code requirements. 2. The testing of the above items shall be completed in accordance with the enclosed plans and specifications. 3. The anticipated contract time is 220 consecutive calendar days. It is expected that your services will be completed on an on-call basis, with a required response time of 24 hours. It is anticipated that construction will start in February 2001. 4. A completed contract for your execution will be forwarded with the notice -to -proceed. 6. As soon as your services are complete, your firm should invoice Delta Airport Consultants, Inc. Your invoice will then be included with the next Delta invoice. Payment for your services will be forwarded within ten (10) days upon receipt of payment from the Owner. 7. Since this project is funded by the Federal Government, please confirm that your firm is in compliance with the attached Title VI Assurances. 8. If your firm is a Disadvantaged Business Enterprise, please include a copy of your DBE certification with your proposal.
