RESOLUTION
WHEREAS, it is the opinion of the City Council that the best interests of the
citizens of the City of Lubbock would be served by establishing a Smoking Ordinance Ad
Hoc Committee for the City of Lubbock; and
WHEREAS, the City Council desires to have said Committee study the public
health issue of smoking in public places and the current City and State regulations on
smoking in the City of Lubbock and to seek input from the City Board of Health, medical
experts and from those persons, businesses and other places that are affected by smoking
in public places; and
WHEREAS, the City Council desires to have the Committee conduct a public
hearing to receive comments upon this topic from the general public during the course of
the Committee's study of this issue; and
WHEREAS, the City Council desires to have the Committee provide monthly
reports to the City Board of Health and a final report including any Board of Health
recommendations from said Committee to the City Council in not more than 120 days
recommending a course of action upon this issue to the City Council; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT a Smoking Ordinance Ad Hoc Committee is hereby created by the City
Council of the City of Lubbock, which shall perform its duties in accordance with the
following criteria:
1. Study the public health issue of smoking in public places and the current City
and State regulations on smoking in the City of Lubbock and seek input from the City
Board of Health, medical experts and from those persons, businesses and other places
that are affected by smoking in public places in the City of Lubbock.
2. Conduct a public hearing to receive input from the general public on the topic
of smoking in public places.
3. The committee will consist of eleven (11) members. One member will be
appointed by each member of the City Council and three members (including one from
Lubbock's Restaurant Association, one serving in the public health area and one that is a
member of the business community) will be appointed jointly by the City Council. The
Mayor will also appoint a member to serve as the Chair for the Committee. The City
Council will also appoint an ex officio member without voting rights who has prior
experience with this issue as a member of the City Health Board to provide historical
background and identify potential problems for the Committee. The City Manager of the
City of Lubbock shall appoint a staff liaison to the Committee.
4. Regular meetings will be held at times and locations established by a majority
of the Committee members. A simple majority of members shall constitute a quorum, and
a majority vote of the quorum shall be required for any action to be taken by the
Committee.
5. The Smoking Ordinance Ad Hoc Committee shall serve for a term of
approximately 120 days or until the objective is accomplished.
6. The chairperson of the Committee shall present a monthly report to the City
Board of Health and a final report including any Board of Health recommendations to the
City Council recommending a course of action with regard to the above topic as
requested by the City Council.
