ORDINANCE NO. 2008-00048
AN ORDINANCE ABANDONING AND CLOSING A 25 -FOOT UTILITY
SND PUBLIC ACCESS EASEMENT LOCATED IN BLOCK D-6, SECTION 1,
.UBBOCK COUNTY, TEXAS AND MORE PARTICULARLY DESCRIBED IN THE
SODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE
)FFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND
'LOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR A `a

WHEREAS, the City Council finds that the easement as hereinafter described in
body of this Ordinance is no longer needed for easement purposes and for public use;CM
it would be in the public interest to close, vacate and abandon the same for easement �+
poses and for public use, and it would be in the public interest to close, vacate and w
adon the same; NOW THEREFORE:
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement as hereinafter described shall BE and the same
hereby closed, vacated and abandoned for easement purposes and for public use, such
sement being more particularly described in attached Exhibit "A."
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
official maps of the City of Lubbock to reflect said abandonment and closing,
ving the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
of this Ordinance be declared unconstitutional or invalid for any reason, the
ider of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
thorized and directed to cause publication of the descriptive caption of this Ordinance
an alternative method provided by law.
AND IT IS SO ORDERED.

METES AND BOUNDS DESCRIPTION for a 25' Utility and Public Access Easement to be closed located in Section 1, Block D-
6, Lubbock County, Texas, being further described as follows:
BEGINNING at a point in the North right-of-way line of 19th Street, same being a point in the South line of Tract B of Tracts A-1,
B, C-1, and E, a replat of Tracts A and C, Caravan Addition to the City of Lubbock, Lubbock County, Texas, according to the
map, plat and/or dedication deed thereof recorded in Volume 7626, Page 138, Official Public Records of Lubbock County,
Texas, which bears West a distance of 999.55 feet and North 51.63 feet from the Southeast comer of Section 1, Block D-6,
Lubbock County, Texas, for the Southeast comer of this tract;
THENCE N. 89°49'46" W., along the South line of said Tract B, at 15.00 feet pass a point for the Southwest comer of said Tract
B and the Southeast comer of said Tract A-1, continuing for a total distance of 25.00 feet to the Southwest comer of this tract;
THENCE N. 00°13'20" E., a distance of 463.30 feet to a point;
THENCE N. 44°44'38" W., a distance of 14.15 feet to a point;
THENCE N. 89042'36" W., a distance of 109.82 feet to a point in the East line of Lot 5, Block 4, Brown Crest Subdivision, an
addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or dedication deed thereof recorded in

THENCE N. 00°13'05" E., along the East line of said Lot 5 and the West line of said Tract A-1, at 20.00 feet pass the North line
said Tract A-1 and the South line of said Tract E, continuing for a total distance of 25.00 feet to a point for the Northwest comer
of this tract;
THENCE S. 89042'36" E., a distance of 312.62 feet to a point in the East line of said Tract E and in the West line of said Tract
C-1, for the Northeast comer of this tract;
