AN ORDINANCE ABANDONING AND CLOSING A TEMPORARY
GARBAGE SERVICE AND TEMPORARY UNDERGROUND UTILITY
EASEMENT, LOCATED IN BLOCK E, SECTION 5, LUBBOCK COUNTY, TEXAS
AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE;
DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE
CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the easements as hereinafter described in
the body of this Ordinance are no longer needed for easement purposes and for public
use; and it would be in the public interest to close, vacate and abandon the same for
easement purposes and for public use, and it would be in the public interest to close,
vacate and abandon the same; NOW THEREFORE:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easements as hereinafter described shall BE and the
ame are hereby closed, vacated and abandoned for purposes and for public use, such
asements being more particularly described in attached Exhibit "A".
SUCTION 2. TI IAT the City Engineer is hereby authorized and directed to mark
he official maps of the City of Lubbock to reflect said abandonment and closing.

SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
of this Ordinance be declared unconstitutional or invalid for any reason, the

uthorized and directed to cause publication of the descriptive caption of this Ordinance

This is to certify that Joe Stettheimer Development, LLP, hereinafter referred to as "Dedicator" is the sole owner of
a tract of land. That tract of land is not and never has been a part of their respective homesteads more particularly
described as follows:
Metes and Bounds description of a 0.115 Acre Tract, out of Section 5, Block E, Lubbock County, Texas, to be
dedicated as Temporary Garbage Service Easement and Temporary Underground Utility Easement, further described as
follows;
BEGINNING at a point In the East line of the Tract described in Volume 7321, Page 57, Lubbock County Real
Property Records, which bears N 0e03'41" W, 1586.13 feet and East, 2226.32 feet, from the Southwest comer of Section
5, Block E;
THENCE W 167.12 feet;
THENCE N 30.00 feet to a set %:" rod with cap marked RPLS 4460, for the Northwest comer of this tract;
THENCE E 167.10 feet a set''/a" rod with cap marked RPLS 4460, for the Northwest comer of this tract;
THENCE S 0°01'30" E, 30.00 feet to the Place of Beginning and containing 0.115 Acres Including any Right -of -
