RESOLUTION
WHEREAS, the City of Lubbock and its municipally owned electric
utility. Lubbock Power & Light ("LP&L") are Currently served \,vith wholesale
Power delivered through the Southwest Power Pool Regional Transmission
Organization ("SPIP",),
WHEREAS, the wholesale power contract wherein LP&L acquires its
power is to expire May )1,1. 2019
WHEREEAS.' LP&L contracted previously with SOLIthwestern PublicService for the period of time from and after May 31, 2019 to May 31, 2044 for
a portion of its power needs (the "SPS" 1...oad");
WHERFAS, LP&L participated in two separate procurement processes
regarding power options subsequent to May 11, 2019 (the "Procurement
Processes");
WHERI-EAS, the Procurement Processes did not reveal a complete solution
fOr IIP&I.., S future power needs;
WHEREAS, although the PrOCUrerrient Processes did not reveal a solution
in and of themselves, the evaluation of the responses received, along with
independent analyses of Regional 'ransinission Organizations and wholesale
electricity markets (collectively, the "Analysis"), provided a path forward to
LP&L;
WHERE AS, the Analysis clearly indicates that the customers of LP&L
would be best served by a migration of its load, less and except the SPS Load
(the "ERCOT Load"), from SPP to the Electric Reliability Council or Texas
Regional Transmission Organization ("ERCOT"'):
WHER]"AS, the rnigration of the ERCOT Load to ERGOT will require
regulatory activities at ERCOT and before the Public Utility Commission of'
`rexas (the
WHEREAS, the City Council of the City of Lubbock desires that all
regulatory activities be initiated and undertaken in an effort to cause the
migration ofthe I'ACOT Load to ER(70T: NOW, THEREFORE:
BE IT RESOLVED BY THE" CITY COUNCIL OFTHE CITY OF LUBBOCK:

W17, to the extent the City Council possesses governance jurisdiction
over LP&[,, as prescribed by the City Charter and Ordinances of the City of
Lubbock, including without limitation. Chapter 1. Article XII, Section I of the
City Charter and Chapter 2, Article 2.03", Division 12 of the Code of
Ordinances, the Director of Electric Utilities BF' and is hereby authorized and
directed,, for and on behalf' of the City of Lubbock, to execute or cause to be
executed any and all pleadings, rep orts. studies or other filings (collectively, the
"Pleadings-) required by. advisable to be filed with, ERCOT and/or the PUC,
and to file or caused to be filed the Pleadings, and to present testimony and
otherwise provide support, within and bcf'orc ER(70T and/or the PLIC. in an
effort to cause the migration of the ERCOT I-oad lona SPI) to ERCOT.
