Townhouses - 08/27/1975KJ: rmj ORDINANCE NO. 7137 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLO ING CHANGE: - ZONE CASE NO, 19'16-A: CHANGE A TRACT OF LAND OUT OF'SEC TION 3,- BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM R-1 SPECIFIC USE, TOWNHOUSES TO A-1 ZONING DISTRICT SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAV- INGS CLAUSE AND PROVIDING FOR PUBLICATION, WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation, which was received by the City Council and after due con- siderati®n, the City Council finds that making the proposed change as herein- after set out will be in the ,public interest; and, WHEREAS, all conditions precedent required by law for a valid amend meet to the Zoning Ordinance and Map have been fully complied with, as well as givin notices in compliance with Section 26 of Ordinance No. 7084 as well as notic ;s provided by Article 1011f, Vernon's Annotated Civil Statutes, amende in 1961, and notice was duly published in the Lubbock Morning Ava- lanche J urnal more than fifteen (15) days prior to the date of the public hear- ing befo e the City Council on such proposed amendment, and the public hear- ing acco ding to said notice was duly held in the City Council Room on the second f oor of the City Hall, Lubbock, Texas; at which time persons appeare in suppo of the proposal; and, after said hearing, it was by the City Council determi ed that it would be in the public interest, due to changed conditions, that the oning Ordinance and the Zoning Map be amended in the manner here- inafter st forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to -wit: ZONE CASE NO, 1916-A Change a tract of land out of Section_3, Block E-2, City of Lubbock, Lubbock County, Texas, which is more particularly described by metes and bounds to -wit: BEGINNING at a point which is 20. 97T north of the northeast corner of Lot 1, Block 25, Rushland Park Addition; KJ:m THENCE North a distance of 129. 66 feet to a point of curvature; THENCE Northwesterly along curve to the left (radius equals 15 feet, angle equals 79' 241 35" tangent equals 12. 46 feet, chord equals 19.161 ) to a point of tangency; THENCE North a distance of 56. 97 feet to a point; THENCE South 79' 241 35" east a distance of 42. 98 feet to a point; THENCE North 00' 03t 27" east a distance of 747. 46 feet to a point; THENCE South 89' 491 36" North a distance of 1319. 11 feet to a point; THENCE South a distance of 874.30 feet to a point; THENCE East a distance of 1089. 73 feet to a point; THENCE South 72' 292 39" east a distance of 208. 28 to the Place of Beginning. Except for the following described tract of land which is to be changed to "R-1" Specific Use Townhouses under provisions of Section 22. 3-2. BEGINNING at a point which is M. 971 north of the north- east corner of Lot 1, Block 25, Rushland Park Addition. TO THE FOLLOWING CONDITIONS: Development shall be in accordance, with the ite plan approved by the City Council on 11th day of August, 1975, and made a part hereof. A-1 Zoning District Parking Requirements shall be complied,.-" with. SECTION 2. THAT from and after passage and effective date of this Ordinan le said lots, tracts and parcels of land described in Section I hereofq shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT any person, firm or corporation owning or opera- ting the subject property failing to comply with the conditions imposed by Section I hereof shall be guilty of a. misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and everyday's violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section I hereof shall render the President, Vice-president, General Manager, Local Manager and Local Agent liable to the penalty prescribed in this section. 3- KJ:rmj SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be..ideclared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5, THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
