HEREAS,g the City Council has determined that the changes indicated herein be w would be in the best interest of the citizens of the City of Lubbock; NOW THE EFORE: BE IT OR AINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: S CTION 1. THAT Chapter 34 of the Code of Ordinances, City of Lubboc BE and is hereby amended by adding thereto new Sections 34 72,, 34-73 34 74, and 34-75 which shall read as follows: Section 34-72 - Definitions The following definitions shall be applied in deter- mining sewer service and charges for sewer service; (a) Single Family Residence shall meanone building structure or mobile home on a. single lot or tract oc- cupied as one dwelling unit. (5) Multi-oFamily Dwelling Units shall mean two or more dwelling units on a single lot or tract, whether in one building or more than one building or structure including a mobile home or homes located on a single lot or tract of land irrespective of the fact that water service for each unit may or may not be on one meter or all on the same meter. Provided howevers,, that the same definition shall apply to water users from a private supplier. x Section 34-73 " Rates Charged for Sewer Service (a) There shall be charged for sewer service to all residences, places of business,, private and public buildings,, churches;, schools and institutions,, the following service charge. Single Family Residence to $1. 50 per month Multi. In the event the person, i farm or institution does not receive water from the City Water Department, a separate monthly state- ment shall be spgt.ring such service, Section 34*44 Disconaeot for Non-payment of Sewer 4 Service ^ (a) In the event any or institution presently connected with Ci-of Lubbock water service fails or refuses to pay the assessed sewer change withcln 15 da.ys after dine date, water and sewer service shall be discontinued at the premises assessed and not be renewed until payrnerat of the assessed cha.rge's plus the om, ditions and charges for re-oestabliqbment of water service as provided in Section 34_4$ of this code, (b) In -the event any person., firm or institution not connected with City of Lubbock Water Service fails or refuses to ,pay the assessed sewer charge within 15 clays after due date, sewer ° s'eryiee shall be dis- connected for those' residence's or wasineases assessed` and a $5.0, 00 reconnect charge shall be due with all back paym, Ants before reconm ct will be naa.de. Se-ction 34-75 - Measurement of Sewer, e Flow of Com-0 mercial or iandustrial Users Not on Water Service and or with Private 'W'a`ter. It shall be the responsibility cif ai]'�'tlrtas Commercial or Industrial users to provide a satisfactory metering device for the sewerage flow or metering for the pri- vate water supplier to deterrn' , the q;o atity of sewer- age discharged and the service 1 binge. In the event the metering. measurement is not provided sewer Serb vice shall be detarmi.ned``and assessed by the Cityof Lubbock until such a measurement is provided. SECTION 2„ THAT should any parraph, section sentence clause phrase orl word of this Ordinance be declared unconstitutional or invalid for any reason, tl e remainder bf this Ordinance shall not be affected thereby.
