ORDINANCE NO. 9091
AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY
OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF PORTIONS OF SECTION 8-4 WITH
REGARD TO THREE POLLING PLACES AND ONE PRECINCT BOUNDARY; PROVIDING FOR A
MAP OF THE VOTING PRECINCTS OF THE CITY OF LUBBOCK; PROVIDING THAT ALL
PORTIONS OF SECTION 8-4 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock deems it to be in
the best interests of the citizens of the City of Lubbock to delete the
presently named polling places for Voting Precinct Nos. 52, 57 and 71
because of objections of the owners of the buildings named as polling
places in those precincts to the conduct of recent elections in such
buildings; and
WHEREAS, the City Council of the City of Lubbock deems it to be in
the best interests of the citizens of the City of Lubbock to amend the
boundaries of Voting Precinct No. 40 to reflect a recently approved
annexation; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Code of Ordinances of the City of Lubbock,
Texas, BE and is hereby amended by altering the polling places recited in
Section 8-4 for City Voting Precincts Nos. 52, 57 and 71 to read as
follows:
Voting Precinct No. 52. The voting place shall be All Saints School.
Voting Precinct No. 57. The voting place shall be as is hereafter
designated by election order.
Voting Precinct No. 71. The voting place shall be as is hereafter
designated by election order.
SECTION 2. THAT the Code of Ordinances of the City of Lubbock,
Texas, BE and is hereby amended by altering the boundary description
recited in Section 8-4 for the following City Voting Precinct:
Voting Precinct No. 40. Beginning at the intersection of East 4th
Street and the east city limits, a point 150 feet east of the center
line of Olive Avenue; thence west along East 4th Street to its inter-
section with Quirt Avenue; thence north along Quirt Avenue to its
intersection with Parkway Drive, U.S. Highway 82; thence west along
Parkway Drive, U.S. Highway 82, to its intersection with MacKenzie
State Park Road; thence south along the MacKenzie State Park Road to
its intersection with the Yellowhouse Fork of the Brazos River, near
East Broadway Street; thence south along the Yellowhouse Fork of the
Brazos River to its intersection with East 19th Street; thence east
along East 19th Street to the east city limits, a point 150 feet east
of the center line of Olive Avenue; thence north along the city
limits, a line 150 feet east of the center line of Olive Avenue to a
point 150 feet east and 452.59 feet north of the intersection of the
center lines of East 19th Street and Olive Avenue; thence north-
easterly along the city limits, 1,186.5 feet to a point; thence west
along the city limits 839 feet to a point; thence north along the
city limits, a line 150 feet east of the center line of Olive Avenue
to the point of beginning. The voting place shall be Posey
Elementary School.
SECTION 3. THAT the Code of Ordinances of the City of Lubbock,
Texas, BE and is hereby amended by deleting paragraph 8-4(c) and sub-
stituting therefor the following:
(c) The voting precincts and voting districts set out in this
section are hereby delineated on the map denominated "City of Lubbock
Voting Precincts, effective September 1, 1987.11 A copy of said map
is attached to and made a part of this Ordinance as if fully copied
herein in detail. A copy of the original of such map shall be kept
in the office of the City Secretary and shall be available for public
inspection, and at each special and general city election, a true
copy of said map shall be furnished by the City Secretary to each of
the presiding judges of the voting precincts for such special or
general city election.
SECTION 4. THAT all portions of Chapter 8 of the Code of Ordinances
of the City of Lubbock not hereinabove altered shall remain as they are.
SECTION 5. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected
thereby.
SECTION 6. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of
this Ordinance as an alternative method of publication provided by law.
