AN ORDINANCE AMENDING ORDINANCES NO. 4805, 5099, 5312, 5545, 5760, 5946, 6191 and 6450 OF THE CITY OF LUBBOCK BY REPEALING SECTION 2 OF EAC)l OF SAID ORDINANCES, SUCH SECTION PROVIDING FOR APPLICA- TION OF ESIDJE TAXES COLLECTED TO THE GENERAL` FUND OF THE CITY F LUBB K AFTER INTEREST AND SINKING FUND REQUIREMENTS HAVE BE9W PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICA- TION. WHE REAS, the City Council in its consideration of the tax rate necessary for the op ration of the affairs of the City of Lubbock for the years 1965, 1966, 196 19681 1969 b970, 1971 and 1972 provided that tie portion of the tax rate established as neces se ry to be set aside in the Interest and. Sinking Fund should be so collecte and applied up to a certain figure calculated to properly provide for all necessary interest p yments and reserves and that once this figure was colleetedthe residue of taxes cc, llected and to be collected for such year would be placed within the General Find of the City; and WHE P, EAS, it has been determined that' such. transfer or application of resid taxes coR cted could not be properly made; NOW THEREFORE: BE IT OR 2iJNED BY THE CITY COUNCIL ;OF THE CITY OF LUBB'OCK: SEC ION 1. THAT Section 2 of Ordinances 4805, 5099, 5312, 5545, 5760, 59460 6191 and 6450 of the City of Lu'bbo , 18E and is hereby repealed. SECTION 2. THAT it is the intention of this Ordinance to change only the section of i iach ordinance amended hereby which relates- to the application of residue to es collected in the respective tax year Which were allocated to the Interest ani Sinking Fund and all other sections of such ordinancesshall remain in -fuR force znd effect. SECU ION 3. THAT should any section, paragraph, s:entencie, clause, phras or word of this Ordinance be declared unconstitutional or invalid for any reason, the remain er of this Ordinance shall not be affected thereby.` SECTION 4. THAT the City Secretary is hereby authorized to cause Publica- tion of the descriptive caption of this Ordinance as an alternative method'provided by law.
