ORDINANCE NO. 8463
AN ORDINANCE .AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK, TEXAS, BY ADDING THERETO A NEW VOTING PRECINCT NO. 56 AND DELETING
THEREFROM FORMER VOTING PRECINCT NO. 51; PROVIDING A MAP OF THE VOTING PRE-
CINCTS OF THE CITY OF LUBBOCK; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT
AMENDED HEREBY SHALL REMAIN THE.SAME; PROVIDING A SAVINGS CLAUSE; DECLARING AN
EMERGENCY; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City of Lubbock, Texas has annexed additional territory into
the city limits since the last previous city election by Ordinance No. 8417;
and
WHEREAS, the Texas Election Code, Sec. 2.05, requires that city voting
precincts shall not cut across a county voting precinct line; and
WHEREAS, the area annexed is contained entirely with Lubbock County Voting
Precinct No. 56; and
WHEREAS, the precinct boundary description for former Voting Precinct No.
51 should have been deleted from Chapter 8 by Ordinance No. 8278, as it was
consolidated with Voting Precinct No. 20, but such instruction to delete was
inadvertently omitted from such Ordinance; and
WHEREAS, the City Council of the City of Lubbock deems it to be in the
best interest of the citizens of the City of Lubbock to add a new Voting Pre-
cinct No. 56 and to delete former Voting Precinct No. 51 from Chapter 8 of the
Code of Ordinances; and
WHEREAS, the death of Mayor Bill McAlister on June 27, 1983, has created
the necessity for a special election to fill such vacancy as soon as possible,
which requires that this Ordinance be passed as an emergency measure; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Code of Ordinances of the City of Lubbock, Texas,
be and is hereby amended by amending the language of Sec. 8-4 to provide a
boundary description for a new Voting Precinct No. 56, as follows:
Voting Precinct No. 56. Beginning at a point in the south city
limits, said point being 660 feet south and 660 feet west of the northeast
corner of Section 16, Block E-2, which presently is the intersection of
98th Street and Quaker Avenue; thence east along the south city limits
approximately 3,150 feet to the west city limits; thence south along the
west city limits approximately 1,980 feet to the south city limits; thence
west approximately 3,150 feet to a point; thence north to the place of
beginning. The voting place shall be as is hereafter designated by
election order.
SECTION 2. THAT the Code of Ordinances of the City of Lubbock, Texas,
be and is hereby amended by deleting the boundary description of former Voting
Precinct No. 51 from Sec. 8-4.
SECTION 3. THAT the Code of Ordinances of the City of Lubbock be and
is hereby amended by deleting the paragraph immediately following the boundary
description of Voting Precinct No. 67 and inserting the following paragraph in
its place:
The voting precincts set out in this Section are hereby delineated on
the map denominated "City of Lubbock Voting Precincts, Effective August 1,
1983." A copy of said map is attached to and made a part hereof as though
fully copied herein in detail. An original copy of said map shall be kept
in the Office of the City Secretary and shall be open to public inspection,
and at each special and general City election, a true copy of said map
shall be furnished by the City Secretary to each of the presiding judges
of each voting precinct for said special or general election.
SECTION 4. THAT all portions of Sec. 8-4 of the Code of Ordinances of
the City of Lubbock not hereinabove altered shall remain as they are.
SECTION 5. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 6. THAT the fact that public necessity and convenience requires
that this Ordinance be passed as an emergency measure for reasons set forth in
the preamble hereof, therefore the rule requiring that no Ordinance shall be
finally passed on the day of its introduction is suspended, and this Ordinance
is declared to be an emergency measure to take effect from and after its passage.
SECTION 7. THAT although this Ordinance carries no penalty and there-
fore is not required to be published, the City Secretary is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance
as an alternative means of publication provided by law so that affected citizens
may be advised as to such voting precinct changes.
