HomeMy WebLinkAboutOrdinance - 8375-1982 - Amending Chapter 10 Precinct 67. - 10/14/1982.11 ' ' \0-\d.-'1d- \O• 'U-'1~ DGV:da ORDINANCE NO. 8375 _....::...;...;;._ ___ _ AN ORDINANCE AMENDING CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING THERETO A NEW VOTING PRECINCT NO. 67 AND AMENDING THE BOUNDARY DESCRIPTION OF PRESENT VOTING PRECINCT NO. 52; PROVIDING A MAP OF THE VOTING PRECINCTS OF THE CITY OF LUBBOCK; PROVIDING THAT ALL PORTIONS OF CHAPTER 10 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, Lubbock County, Texas, has altered its voting precinct lines within the City of Lubbock since the last City election by creating a new Voting Precinct No. 67 out of a portion of Voting Precinct No. 52; and WHEREAS, the Texas Election Code, Sec. 2.05, requires that city voting precincts may not cut across a county voting precinct line; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interests of the City of Lubbock to add a new Voting Precinct No. 67 created from a portion of Voting Precinct No. 52; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Code of Ordinances of the City of Lubbock, Texas, be and is hereby amended by amending the language of Sec. 10-6 to provide a new boundary description of Voting Precinct No. 52 as follows: Voting l'recinct No. 52. Beginning at .the intersection of 82nd Street and Indiana Avenue; thence east along 82nd Street to its intersection with University Avenue; thence south along University Avenue to its intersec- tion with 98th Street; thence east.along 98th Street to a point ~50 feet east of Avenue U; thence south along the east city limits to the south city limits, 660 feet south of 98th Street; thence west along the south city limits to the east city limits, 660 feet east of University Avenue; thence south along the east city limits to the south city limits, 660 feet south of 114th Street; thence west along the south city limits to the west city limits, 660 feet west of Indiana Avenue; thence north along the west city limits, 3,300 feet to a point; thence east 660 feet to Indiana Avenue; thence north along lndiana Avenue to the point of beginning. The voting place shall be Indiana Baptist Church. SECTION 2. THAT the Code of Ordinances of the City of Lubbock, Texas, be And is hereby amended by amending the language of Sec. 10-6 to provide a boundary description for a new Voting Precinct No. 67 as follows: Voting Precinct No. 67. Beginning at the intersection of University Avenue and 82nd Street; thence east along 82nd Street to a point 150 feet east of Avenue U; thence south along the east city limits line to its intersection with 98th Street; thence west along 98th Street to its intersection with University Avenue; thence north along University Avenue to the point of beginning. The voting place shall be as is hereafter designated by election order. I• t SECTION 3. THAT the Code of Ordinances of the City of Lubbock be and is hereby amended by deleting the paragraph immediately following the boundary description of Voting Precinct No. 66 and inserting immediately after the boundary description of new Voting Precinct No. 67, the following paragraph: The voting precincts set out in this Section are hereby delineated o~he map denominated "City of Lubbock Voting Precincts, Effective .. I , 1983 • " A copy of said map is attached to and made ~«F~p~a~r~tdh~e~r~o-f~a-s--t~ho-ugh fully copied herein in detail. An original copy of said map shall be kept in the Office of the City Secretary and shall be open to public inspection, and at each special and general City elec- tion, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of each voting precinct for said special or general election. SECTION 4. THAT all portions of Sec. 10-6 of the Code of Ordinances of the City of Lubbock not hereinabove altered shall remain as they are. SECTION 5. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT although this Ordinance carries no penalty and therefore is not required to be published, the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance so that affected citizens may be alerted to such boundary changes.
