RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and
on behalf of the City of Lubbock, a Quitclaim Deed associated with a portion of 36th Street, as
described in Volume 447, Page 256, and Volume 449, Page 113 of the Deed Records of
Lubbock County, Texas, by and between the City of Lubbock and Thomas Eddy & Jeffrey Pat
McNeill, and related documents. Said portion of 36th Street was previously closed, vacated,
and abandoned by City of Lubbock Ordinance No. 2020-00003, passed on second reading by
the City Council of the City of Lubbock on January 28, 2020. Said Quitclaim Deed is attached
hereto and incorporated in this resolution as if fully set forth herein and shall be included in
the minutes of the City Council.

QUITCLAIM DEED
THE STATE OF TEXAS
COUNTY OF LUBBOCK
KNOW ALL MEN BY THESE PRESENTS:
THAT the CITY OF LUBBOCK, a Home Rule Municipality in the County of Lubbock,
State of Texas, hereinafter called "GRANTOR", for and in consideration of the sum of TEN AND
NO/lOO DOLLARS ($10.00) and other good and valuable consideration to GRANTOR in hand
paid by THOMAS EDDY & JEFFREY PAT MCNEILL, hereinafter called "GRANTEE", the
receipt of which is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM,
RELEASE and FOREVER QUITCLAIM unto the said GRANTEE, all of GRANTOR'S rights,
title and interest in and to that certain tract or parcel of land lying and being situated in the County
of Lubbock State of Texas, more particularly described in attached Exhibit "A".
THE QUITCLAIM QF THE PRQPERTY IS ON A "WHERE IS", "AS IS" AND "WITH
ALL FAULTS" BASIS, AND IS WITHOUT REPRESENTATION OR WARRANITY
WHATSOEVER, EXPRESSED, STATUTORY OR IMPLIED, INCLUDING, BUT WITHOUT
LIMITATION, AS TO TITLE, INCLUDING, BUT NOT LIMITED TO THE EXISTENCE OF
LIENS AGAINST THE PROPERTY, THE DESCRIPTION, PHYSICAL AND
ENVIROMENTAL CONDITION OF THE PROPERTY, QUALITY, VALUE, FITNESS FOR
PURPOSE, MERCHARNTABILITY, OR OTHERWISE.
TO HAVE AND TO HOLD the same premises together with all and singular the rights,
privileges and appurtenances thereto in any manner belonging unto the said GRANTEE, its
successors and assigns forever, so that neither the GRANTOR, its successors or assigns, nor any
persons claiming under GRANTOR shall at any time hereafter have, claim or demand any right to
the title to the aforesaid premises or appurtenances or any part thereof.

METES AND BOUNDS DESCRIPTION of a portion of 36th Street,as described in Volume 447,Page 256,and
Volume 449,Page 113 of the Deed Records of Lubbock County,Texas(DRLCT), being further described as follows:
BEGINNING at a 1/2"square tube found in the South right-of-way line of 36th Street as described in
Volume 447,Page 256,DRLCT, being the Northeast comer of Lot 3, McNeill Heights,an addition to the City of
Lubbock, Lubbock County,Texas,according to the map,plat and/or dedication deed thereof recorded in Volume 702,
Page 421 of the Deed Records of Lubbock County,Texas(DRLCT),for the most Southerly Southeast comer of this
tract;
THENCE S. 89055'23"W., along the Northern boundary of said Lot 3, and the South right-of-way line of said 36th
Street,a distance of 71.55 feet to a 112"square tube found at a corner of said Lot 3,the same being the Southwest
corner of said right-of--way dedication and the Southwest corner of this tract;
