duly presented to the Planning and Zoning Commission for its recommendation which was
received by the City Counc i f and, after· due cons i de ration, the City Counc i 1 finds
that making the proposed cha_nge as hereinafter set out wi 11 be in the public inter-
est; and;
WHEREAS, all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map have been fully comp! ied with, as well as giv.ing. notices
in compliance with Section 26 of Ordinance No. 7084, as well as notices· provided by
Article lOllf, Vernon 1 s Annotated Civil Statutes, amended in 1961, and notice was
duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days
prior to the date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice was duly held in the
City Council Room on the second· floor of 'the City Hall, Lubbock, Texas, at which
time persons appeared in support of the proposal; and, after said hearing, it was
by the City Council determined that it would be in the public interest,' due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the
man·ner hereinafter set forth in t·he .body of this Ordinance and this Ordinance having
been int roduced prior to first readi_ng hereof; NOW THEREFORE: ·
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoni_ng Map BE and the same
are hereby amended as follows, to-wit:
ZONE CASE NO." ·1223-B
Change a tract of land out of Section 12, Block E-2, City of Lubbock,
11.ubbock County, Texas, from C-2 to C-3 zoning district. This property
is .further described by metes and bounds as· folclows:
BEGINNING at a found 3/811 rod, at the southeast corner of Lot 4, Times
Square Addition to the C'ity of Lubbock, Lubbock County, Texas;

THENCE North 89@57 1 East al~ng the North ~ight-of-way line of 74th Street,
a distance of 1377.10 feet to a point of curvature;
THENCE Northeasterly, around a curve to the left, said curve having a
radius of 15.0 feet, a delta angle of 90°02 13T1, tangent lengths ~f
15.01 feet, and a chord distan·ce of 2L22 feet, to ·a point 'in the West
~ight-of-way line of University Avenue;
THENCE North 00°05 13711 West, along the West right-of-way line of
University Avenue, a distance or 153.19. feet to a found 3/411 rod at a
point of curvature;
.THENCE Northwesterly, around a curve to the left, said curve having a
radius of .215.00 feet, a delta a_ngle of 84°.16 1 3011 , ta_ngent le_nglllbs of
194.52 feet, and a chord distance of 288.49 feet, to a found 3/4" rod in the
Southerly right-of-way line of Loop 289;
THENCE North 84°22':07" West along the Southerly right-of-way line of Loop
289, a distance of 549.20 feet to a found 2 inch iron pipe;
THENCE South 89°57 1West along the Southerly right-of-way line of Loop 289,
a distance of 651. 70 feet to a found 3/811 rod at the Northeast corner of Lot
4, Times Square Addition to the City of Lubbock, Lubbock County, Texas;
THENCE South 00°03' East along the East line of said Lot 4, a distance of
436.35 feet to the Place of Beginning.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That development be in accordance with the site plan approved by the City
Council on September 28, 1978.
2. That the South side of the Building be constructed from materials compatible
with the existing offices and utilizing rock or brick.
3. That a screening fence be erected on the West property line.
4. That the 10 foot strip of land on the South be landscaped with trees or
other plant material which will visually interrupt the solidarity of the
South wall of the building.
5. That the landscaping on the West side of the building be in accordance
with the landscaping elevation approved by the City Council on
October 12, 1978.
SECTION 2. THAT from and after passage and effective date of this Ordinance
said lots, tracts and parcels of land described in Section 1 hereof shall be changed
to the zoning district indicated and the Official Map is amended in accordance here-
with.
SECTION 3. THAT violation of any provisions of this ordinance shall be deemed
a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in
Section 1-5 of the City Code.
SECTION 4. THAT should any section, paragraph~ sentence, clause, phrase or wor
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause publication o
