Williams Addition - 09/28/1978LGB:yb .. -ORDINANCE NO. 7738 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT, TO WIT: ZONE CASE NO.' 1124-C; CHANGE _LOTS .11, 12 AND THE WEST 6 FEET OF LOT 13,-BLOCK 1; R.C. WILLIAMS ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-3 TO AM SPECIFIC USE PERMIT; PROVIDING FOR A CONDITION; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. . WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and after due notice and public hearing and al 1 matt'ers having ·been done and performed as required by Section 22 of ·zoning Ordinance No. 7084 of the City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code} relating to Specific Use Permits, the City Council finds that due to changed candit'ions, it would be expedient and in the interest of the public heal°th, morals, and general welfare to authorize the granting of the Specific Use Permit as hereinafter set forth; NOW THEREFORE: . . BE IT ORDAINED BY THE Cl.TY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is author- ized to issue a Specific Use Permit to the Applicant in Zone Case No •. 1124-C in accordance with the recommendations and conditions imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning 'and the City· Counci 1 which a re hereby adopted and incorporated herein by reference for all purposes, provided said applicant agrees to be bound by the.terms of the Specific Use Permit, the granting of which is hereby made subject to compli- ance to all provisions of Zoning Ordinance No. 7084, an Ordinance of the City of Lubbock, including particul~rly, but not limited to Section 22 of Zoning Ordinance No. 7084,' which provides that a Specific Use Permit and a Build.ing Permit shall be applied for and secured within thirty-six (36) months of the effective date of the zone change or all undeveloped property shall automati- cally revert back to the previ'ous zoning classification; and the Director of Planning in s·uch event is directed to ·remove from the Zoning Map the legend indica.ting such 1 imited use. The Specific Use authorized ·by this Ordfnance is permi'tted under provision of Section 22.3-20-3 of the Zoning Ordinance on the property respectively described below. · ZONE CASE NO. 1124-C Change Lots 11, 12 and the west 6 feet of Lot 13, Block 1, R.C. Williams Addition, City of Lubbock, Lubbock County, Texas, from R-3 to AM Specific Use Permit. SUBJECT TO THE FOLLOWING CONDITION: 1. That medical offices sha]] not ae permitted as a use. SECTION 2. THAT any person, _finn or corporation owni_ng or operati_ng the subject property failing to comply with the condition imposed by Section I hereof shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a ffoe not to exceed TWO HUNDRED DOLLARS and each and every day•s violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Sectfon 1 hereof shall render the President, Vice-President, Genera,) Man.ager, Loca 1 Man_ager and Loca I _Agent liable to the penalty prescribed in this Section. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared uncons'titutional or invalid for any reason, the remainder of this Ordinance shall not be ·affected thereby.
