ORDINANCE NO. 7101
AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE
PERMT, TO-WIT: ZONE CASE NO. 1660-B: CHANGE LOT 2, AGEE-
PHARR ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS,
FROM AN uA-211 TO AN 11A-2u SPECIFIC USE PERMIT, TO-WIT: PROFES-
SIONAL TYPE OFFICES; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS,. after receiving the recommendations d)£ the Planning and
Zoning Commission and after due notice and public hearing and all matters
having been done and performed as required by Section 14-A of Zoning Ordi ..
nance No. 16 95 of the City of Lubbock, (said Ordinance being an Appendix to
the Lubbock City Code) relating to Specific Use :fermits, the City Council
finds that due to changed conditions, it would be expedient and in the interest
of the public health, morals, and general welfare to authorize the granting of
a Specific Use Permit as hereinafter set forth; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Director of Planning of the City of Lubbock is
authorized to issue a Specific Use Permit to the Applicant in Zone Case No.
1660-B in accordance with the recommendations and conditions imposed by
the Planning and Zoning Commission, on file with the office of the Director o
Planning1 and the City Council which are hereby adopted and incorporated
herein by reference for all purposes, provided said Applicant agrees to be
bound by the terms of the Specific Use Permit, the granting of which is
hereby made subject to compliance to all provisions of Zoning Ordinance No.
1695, an Ordinance of the City of Lubbock, including particularly, but not
limited to, Section 14-A of Zoning Ordinance No. 1660-B within twenty-four
(24) months of the effective date of this Ordinance, the City Secretary-
Treasurer shall be and is hereby authorized and instructed, upon written no-
tice from the Director of Planning that Applicant has not complied with the
provisions, conditions and terms imposed by this Ordinance, to note Appli-
cant's failure to comply on the rm.rgin of the Minutes of the City Council
opposite entry of this Ordinance, and the authorization to issue such Specific
Use Permit is hereby revoked; and the Director of Planning in such event is
directed to remove from the Zoning Map the legend (ndicating such limited
use. The Specific Use authorized by this Ordinance is for Professional Type
Offices, under provisions of Section 14-A. 1-10 of the Zoning Ordinance on
ithe property described below:

Change Lot 2, Agee-Pharr Addition, City of Lubbock, Lubbock
County, Texas. from 11A-211 to "A-211 Specific Use Permit, to-
wit: Professional Type Offices.
SECTION 2. THAT from and after passage and effective date of this
Ordinance. said lots, tracts and parcels of land described in Section 1 hereo
shall be changed to the Zoning District indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT should any Section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
