ORDINANCE NO. 7053
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE
FOLLOWING CHANGE: ZONE CASE NO. 1996: LOTS 1 THRU 7 FROM
11R-l" TO "R-211
• LOTS 331 AND 332 FROM 11R-l11 TO "R-2", LOTS 336
THRU 339 F ROM "R-1" TO ''R-211, LOTS 343 THRU 346 FROM 11R-l"
TO "R-2". LOTS 350 AND 351 FROM "R-111 TO 11R-2". TRACT "A"
FROM "R-111 TO 11C -2A", TRACT 11B 11 FROM "R-1" TO "A-1", TRACT "C"
FROM "R-111 TO 11A-1". TRACT "E11 FROM "R-1" TO llA-1" OF THE
PRELIMINARY PLAT OF MESA PARK ADDITION TO THE CITY OF
LUBBOCK, LUBBOCK COUNTY. TEXAS: SUBJECT '1;0 CONDITIONS;
PROVIDING A PENALTY; PROVIDING A SA VINOS CLAUSE AND PRO-
VIDING FOR PUBLICATION.
WHEREAS. the proposed change in zoning districts as hereinafter
made has been duly presented to the Planning and Zoning Commission for
its recommendation, which was received by the City Council and, after
due consideration. the City Council finds that making the proposed change
as hereinafter set out will be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid
amendment to the Zoning Ordinance and Map have been fully complied with,
as well as giving notices in compliance with Section 20 of Ordinance No.
1695 as well as notices provided by Article l0llf, Vernon1s Annotated
Civil Statutes, amended in 1961, and notice was duly published in the
Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the
date of the public hearing before the City Council on such proposed amend-
ment, and the public hearing according to said notice was duly held in the
City Council Chambers on the Second Floor of the City Hall. Lubbock,
Texas, at which time pem~::ms. appeared in support of the proposal; and.
after said hearing,. it was by the City Council determined that it would be
in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the
body of this Ordinance and this Ordinance having been introduced prior to
first reading hereof; NOW .. THEREFORE:
BE IT ORDAINED BY THE CITY C9UNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map,

Change the following Lots and Tracts from a
preliminary plat of Mesa Park Addition to the City

Districts indicated:

SUBJECT TO THE FOLLOWING CONDITIONS:
1. Development shall be in accordance with the Site Plan
approved by the City Council on April 10, 1975., which is
made a part hereof.
2. Dover Avenue and Durham Avenue shall be opened
onto 66th Street.
3. Tract A: No Service Stations or Car Wash Businesses
shall be permitted.
4. Tract B: Density shall be no more than one unit per
3., 000 sq. ft. of lot area.
5. Tract C: Density shall be no more than one unit per
7, 900 sq. ft. of lot area.
6. Albany Avenue shall be dedicated through to 66th
Street.
7. Tract A: Driveway openings onto Slide Road shall be
a minimum of 1281 South of the exi.'stir:g. center line of
66th Street.
8. Tract A: Buildings shall be set back 551 from Slide
Road.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1

hereof shall be changed to the Zoning District indicated and the Official
Map is amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or oper-
ating the subject property failing to comply with the conditions imposed by
Section l hereof shall be guilty of a misdemeanor and upon conviction
thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS
and each and every day's violation thereof shall constitute a separate and
distinct offense.
The failure of any corporation owning or operating the subject property
to comply with any of the conditions imposed by Section 1 hereof shall
render the President, Vice-President, General Manager, Local Manager
and Local Agent liable to the penalty prescribed in this Section.
SECTION 4. THAT should any Section, paragraph, sentence, clause,.
phrase or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected
thereby.
SECTION 5. THAT the City Secretary is hereby authorized and
directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.
