MARK LOVELL ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS; LOTS 1-44 FROM 11R-l11 TO "R-211 TRACT A FROM 11R-l" TO 11c-2n AND TRACTS B C D & E FRO , , ::, , ''R-1" TO 11A-l 11 ZONING DISTRICTS; SUBJECT TO CONDITION: PROVID- ING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE AND PROVID- ING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and after due con- sideration, the City Council finds that making the proposed change as herein after set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article l0llf, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the dat·e of the public hearing before the City Council on such proposed amendment, an the public hearing according to said notice was duly held in the City Council Room on the Second Floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to the first reading hereof; NOW THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 1805-A Change Tracts of land out of a preliminary plat of S. Mark Lovell Addition to the City of Lubbock, Lubbock County, Texas; Lots 1-44 from 11R-l 11 to "R-211, Tract A from "R-l 1 1 to rrc-211 and Tracts B, C, D & E, from 11R-l 1 1 to 11A-l 1 1 Zoning Districts. KJ:rb SUBJECT TO THE FOLLOWING CONDITION: Development on the 11A-l II Tracts shall not exceed a total of 414 Units as follows: Tract B-106 Units Tract C-140 Units Tract D-84 Units Tract E-84 Units SECTION 2. THAT from and after passage and effective date of this Ordinance said lots~ tracts and parcels of land described in Section l hereof shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECT! ON 3. THAT any person, firm or corporation owning or operat- ing the subject property failing to comply with the condition imposed by Section 1 hereof shall be guilty of a misdemeanor and, upon conviction ther f shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct· offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section 1 hereof shall rende the President, Vice President, General Manager, Local Manager and Local Agent liable to the penalty prescribed in this section. SECTION 4. THAT should any section, paragraph, s.entence, clause, phrase or word of this Ordinance be declared unconstituttdnal or invalid for any reason. the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
