ORDINANCE NO. 6977
AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT
T,0-WIT., ZONE CASE NO. 1615D: CHANGE THE WESTERN PORTION OF TRACT
B, SOUTH PLAINS MALL ADDITION, CITY OF LUBBOCK, TEXAS, FROMAN
"R-2" TO A "C-3" SPECIFIC USE PERMIT, TO-WIT: SHOPPING CENTER AND
RELATED USE; SUBJECT TO A CONDITION; PROVIDING A PENALTY; PRO-
VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS., after receiving the recommendations of the Planning and Zoning
Commission and after due notice and a public hearing and all matters having been
done and performed as required by Section 14-A of Zoning Ordinance No. 1695 of
the City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code)
relating to Specific Use Permits, the City Council finds that due to changed ccn-
ditions, it would be expedient and in the interest of the public health, m:>rals, and
general welfare to authorize the granting of a Specific Use Permit as hereinafter
set forth; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Director of Planning of the City of Lubbock is
authorized to issue a Specific Use Permit to the Applicant in Zone Case No. 1615D
in accordance with the recommendations and conditions imposed by the Planning
and Zoning Commission, on file with the office of the Director of Planning and
the City Council which are hereby adopted and incorporated herein by reference
for all purposes, provided said Applicant agrees to be bound by the terms of the
Specific Use Permit, the granting of which is hereby xm.de subject to compliance
to all provisions of Zoning Ordinance No. 1695, an Ordinance of the City of Lubboc ,
including particularly, but not limited to, Section 14-A of Zoning Ordinance No.
1695 within twenty-four (24) m:>nths of the effective date of this Ordinance,,.the
City Secretary-Treasurer shall be and is hereby authorized and instructed, upon
written 'notice from the Director of Planning that Applicant has not complied with
the provision, conditions and terms imposed by this Ordinance, to note Applicantt
failure to comply on the margin of the M.nutes of the City Council opposite entry
of this Ordinance, and the authorization to issue such Specific Use Permit is
hereby revoked; and the Director of Planning in such event is directed to remove
from the Zoning Map the legend indicating such limited use. The Specific Use
authorized by this Ordinance is for Shopping Centers and related uses, under
provision of Section 14-A. 1-8 of the Zoning Ordinance on the property described
below:
ZONE CASE NO. 1615D
Change the Western Portion of Tract B, South Plains
Mall Addition, City of Lubbock, Texas, from an 11R-211
to a "C-311 Specific Use Permit, to-wit: Shopping
Centers and related uses.
Property is further described by metes and bounds; to-wit:
A tract of land out of Section 28, Block E-2, Lubbock County, Texas, and
being more particularly described as follows:
BEGINNING at a point 2640. 0 feet North and 1508. 6 feet West of the
Southeast corner of Sectlon 28, Block E-2, for the Northeast corner
of this tract;
THENCE South 0° 001 2711 East, 1435. 6 feet to an iron rod for the
Southwest corner of tract uA". South Plains Addition and the
Southeast co·rner of this tract;
THENCE North 55 ° 50' 1011 West along the North R. O .. W. line of Loop
289, 734. 75 feet to a point for the Southwest corner of this tract;
THENCE No·rtheasterly around the arc of a curve to the left whose
radius is 211. 48 feet, 126. 13 feet to a corner of this tract;
THENCE North O O OO' 2711 West, 754.13 feet to a corner of this
tract;
THENCE North 89° 591 3311 East, 520. 0 feet to a corner of this
tract;
THENCE North O O 001 27" West, 150. 0 feet to a corner of thi.s
tract;
THENCE North 89 ° 59t 3311 East, 51. 4 feet to the PLACE OF
BEGINNING.
Containing 14. 539 Acres.

SUBJECT TO 'THE FOLLOWING CONDITION:
The Setbacks, landscapirls and limitations on no additional
free-standing signs shall be as shown on the site plan
approved by the City Council on bsra§er•;J o .; , 1974.
This approved site plan covers not only the property
described in this Ordinance but the entire Tracts A and
B, South Plains Mall Addition, City of Lubbock, Texas.
SECTION 2. THAT any person, firm or corporation owning or operating the
subject property failing to comply with the conditions imposed by Section 1 hereof
shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a
fine not to exceed TWO HUNDRED ($200. 00) DOLLARS and each everydays
violation thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in thi.s section.
SECTION 3. THAT should any paragraphJ sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publi-
catlon of the descriptive caption of this Ordinance as an alternative method
provided by law.
