HomeMy WebLinkAboutOrdinance - 5334-1967 - Changing Prima Facie Speed Limit Spur 327 - 09/28/1967KJ:tp ========~==========================~====~~~~====~= 0'1-ZB-\ClU>~ \0-1~-\qu:t ORDINANCE NO. 5334 AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FOR ALL VEHICLES ON THE FOLLOW ING STREETS IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS TG-WIT: A PORTION OF SPUR 327; AUTH- ORIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDIN- ANCES IN CONFLICT HEREWITH: PROVIDING THAT STREETS OR HIGH'vVAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CON- FLICTS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing body of the City of Lubbock, as authorized by Article 6701d, Section 169(b) Vernon's Texas Civil Statutes, fi.nds that certain prima faci.e speed limits on certain highways are different from what is reasonable or safe and should be altered as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The prima faci.e speed limit established by Article 6701d, Section 166(a) (1) Vernon's Texas Civil Statutes is altered and changed for all vehicles on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas; As shown on the strip map attached hereto and as more particularly des- cribed, to-wit: SPUR 327 A 60 MPH speed zone, for westbound traffic only, beginning at the exit from Loop 289, onto Spur 327, and extending westerly a distance of 0.616 miles. SECTION 2. The attached strip map is made a a part hereof for all intents and purposes and the Ci.ty Secretary and Director of Planning and Traffic are hereby directed to place copies of such map on file i.n their respective offices, open to the inspection by the public. ==========~KJ:tp~====================================================~== Jl SECTION 3. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the 1 imits of the prima facie areas set out in this Ordinance. SECTION 4. Any person, firm, or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200.00) DOLLARS. SECTION 5. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. This ordinance shall become effective ten (10) days after the date of its last publication. SECTION 6. That all ordinances or parts of ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such con- flict exists. SECTION 7. That all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions here- of, and this Ordinance shall be cumulative of all other prima facie speed limit ordinances except those with which it specifically conflicts. SECTION 8. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected there- by.
