ORDINANCE NO. 5832
AN ORDINANeE AMENpING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWIN
CHANGE: ZONE CASE NO. 1448A: CHANGE TWO TRACTS OF LAND OUT OF
THE NORTHEAST¼ OF SECTION 8., BLOCK E-2, LUBBOCK COUNTY., TEXAS
FROM AN 11R-111 TO 11C-2" AND "R-2 11 ZONING DISTRICT; SUBJECT TO CONDI
TIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PRO-
VIDING FOR I-"'OB LICATION. , ,,
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Council and, after due consideration,
the City Council finds that making the proposed change as hereinafter set out will
be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 20 of Ordinance No. 1695 as well as
notices provided by Article l0llf., Vernon's Annotated Civil Statutes, amended in
1961., and notice was duly published in the Lubbock Morning Avalanche Journal
more than fifteen (15) d:cys prior to the date GJf the public hearing before the City
Council on such proposed amendment, and the public hearing according to said
notice was duly held in the City Council Room on the second floor of the City
Hall, Lubbock, Texas at which time persons appeared in support of the proposal;
and, after said hearing, it was by the City Council determined that it would be in
the public interest, due to changed conditions., that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinance and this Ordinance having been introduced prior to first reading hereo
NOW THEREFORE: '
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows., to-wit:
ZONE CASE NO. 1448A
Change two (2) tracts of land out of the Northeast¼ of Section 8,
Block E-2, Lubbock County, Texas from an 11R-1 11 to 11C-2 11
and "R-2° Zoning District. Property is further described to-wit:
TRACT 1 -CHANGE TO 11C-2"
BEGINNING at a point 495 feet South and 30 feet East of the
Northwest corner of the Northeast¼ of Section 8 said Block E-2;
THENCE East 850 feet to a point in the West line of a North-
Sou th alley;

THENCE South 470 feet to a point;
THENCE West 850 feet to a point;
THENCE North 470 feet to the PLACE OF BEGINNING.
TRACT 2 -CHANGE TO "R-211
BEGINNING at a point 965 feet South and 30 feet East of the
Northwest corner of the Northeast¼ of Section 8, said Block E-2;
THENCE East 850 feet to a point in the West line of an alley;
THENCE South 325 feet to a point;
THENCE West 440 feet to a point;
THENCE North 170 feet to a point;
THENCE West 410 feet to a point; '
THENCE North 157 feet to the PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITION: (On Tract 1 only)
THAT development shall be in accordance with the site plan presented
and approved herewith, which is hereby adopted and made a part hereof
for all purposes. Said site plan, prepared by the City Planning Depart-
ment is identified as: Final Site Plan, Zone Case 1448-A, dated March
25, 1970.
SECTION 2. THAT from and after passage and effective date of this Or-
dinance said lots, tracts and parcels of land described in Section 1 hereof shall be
changed to the Zoning District indicated and the Official Map is amended in accord
an ce herewith,
SECTION 3. Any person, firm or corporation owning or operating the sub-
ject property failing to comply with the condition imposed by Section 1 hereof shall
be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine
not to exceed TWO HUNDRED DOLLARS and each and every dayrs violation thereo
shall constitute a separate and distinct offense.
The· failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this Section.
SECTION 4. Should any paragraph. sentence, clause, phrase, or word of
this Ordinance be declared unconstitutional or invalid for any reason~ the remain-
der of this Ordinance shall not be affected thereby.

SECTION 5. THAT the City Secretary is hereby authorized to
cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law. ·
AND IT IS SO ORDERED.
