HomeMy WebLinkAboutOrdinance - 2009-O0077 - Amending Zoning Change IHC To CB-2;Zone Case 2904-A - 08/27/2009First Reading August 27, 2009 Item No. 6.3 ORDINANCE NO. 2009-00077 Second Reading September 10, 2009 Item No. 5.14 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2904-A; A ZONING CHANGE FROM IHC TO CB- 2 SPECIFIC USE ON A W BLANKENSHIP ADDITION NO. 1, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche -Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2904-A SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under provisions of Section 29-24 of the Code of Ordinances of the City of Lubbock from IHC to CB-2 Specific Use on A W Blankenship Addition No. 1, City of Lubbock, Lubbock County, Texas, located at 330 University Avenue, subject to conditions, and being further described as follows: METES AND BOUNDS DESCRIPTION: Attached as Exhibit "A". SUBJECT TO THE FOLLOWING CONDITIONS: 1. The retail parcels) on the east end will develop within the guidelines of CB 2 OR a site plan approved by the Planning Commission at the time the parcel is ready for construction. Should parking be located adjacent to an adjacent street, a low screening wall shall be incorporated into the landscaping to dilute the impact of the parking lot. 2. The proposed hotel shall have a minimum of fifteen feet (15) of setback from the Marsha Sharp Freeway right of way. 3. The parking lot proposed in front of the theater shall be screened with a low wall incorporated into the landscape design. 4. The proposed restaurant adjacent to the parking structure shall have a minimum of ten feet (10') of front setback from the Marsha Sharp Freeway right of way. 5. The proposed parking structure shall have a minimum of seven feet (7') of setback from the Marsha Sharp Freeway right of way line and five feet (5') on 3"d Street right of way line. 6. The proposed theater shall have a minimum of three foot (3') of setback from the 3"d Street right of way line. 7. Whatever type of structure is developed in the location illustrated as multi -family shall meet the average setback of the theater and the parking garage from the 3"d Street right of way line. 8. The proposed parking structure on the site plan does not illustrate the possibility of ground floor retail on the east side nor a rooftop patio as a part of a restaurant or sports grill. Should that square footage occur, the number of at grade parking spaces and available parking in the parking structure will provide adequate parking for those businesses. 9. The proposed site plan will serve as a parking guide, including the possibility of a lot north of 3rd Street as off site parking. Spaces in the parking structure shall be made available to tenants/owners in the center to alleviate any shortage that may occur adjacent to the individual business locations. 10. A cross access and parking easement shall be recorded on the entire parcel prior to any sales or construction. This will be the unifying feature that allows the center to function as a unit or a "shared parking" facility. Zone Case No. 2904-A page -2of4 11. If Boston Avenue is dedicated, the parking structure will meet an average of thirty five feet (3.5') of setback from the right of way, with a wider dimension on the north and a lesser dimension on the south because of a potential curve in Boston Avenue to meet the existing intersection on the Marsha Sharp Freeway. 12. Each structure on the site shall have a detailed site plan with building elevations and materials reviewed and approved by the Planning Commission prior to issuance of a construction permit. The "flavor" of the development will attempt to continue from the Overton North redevelopment styles along University Avenue to the south and the style common to the Texas Tech University campus. 13. For the frontage on University Avenue, only one (1) curb return will be allowed, and it shall be a minimum of one hundred feet (100') north of the intersection of University Avenue and Marsha Sharp Freeway. The curb return may be a shared return if two (2) parcels are developed in the "retail" tract. 14. The initial site plan submitted shall be adopted as the guide to development, recognizing that minor amendments may be approved by the Planning Commission. SECTION 2. THAT the granting of this specific use zoning is hereby made subject to compliance with all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification, which in this case is the IHC zone district; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(24) of Codified Zoning Ordinance No. 7084 on the property described as 330 University Avenue, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/ 100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
