HomeMy WebLinkAboutOrdinance - 2020-O0011 - Amending Chapter 40 - Minimum Yard Requirements - 02/11/2020 First Reading Second Reading January 28,2020 February 11, 2020 Item No. 7.1 Item No. 8.7 ORDINANCE NO. 2020-00011 AN ORDINANCE AMENDING CHAPTER 40 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE MINIMUM YARD REQUIREMENTS FOR THE R-2 TWO-FAMILY ZONING DISTRICT; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; PROVIDING A CONSISTENCY IN APPLICATION CLAUSE, AND PROVIDING FOR PUBLICATION. WHEREAS, the Planning and Zoning Commission of the City of Lubbock, Texas (The "Commission"), during its meeting on January 02, 2020, found that it is in the best interest of the citizens of Lubbock to amend the minimum yard requirements within the R-2 Two-Family zoning district within Chapter 40 of the code of Ordinances of the City of Lubbock (the"Code"); and WHEREAS, the Commission recommends that the City Council of the City of Lubbock, Texas (the"Council")amend Chapter 40 of the City of Lubbock Code of ordinances as amended below; and WHEREAS,the Council finds and determines that it is necessary and proper in the interest of the health, safety, and welfare of the citizens of the City of Lubbock to amend Chapter 40 of the City of Lubbock Code of Ordinances by amending the minimum yard requirements within the R-2 Two-Family zoning district, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1.THAT Section 40.03.0326 of the Code of Ordinances of the City of Lubbock,Texas is hereby amended to read as follows: Sec. 40.03.326 Yard requirements (a) The minimwn yard requirements shall be as set forth in Table 40.03.326. Yard (Minimum building setback distance from property line) Front yard 1 20' Rear yard2 15' Side yard (Interior) 5' Side yard (Street facing)3 5' I. For lots fronting on cul-de-sacs,the minimum front yard shall be five garage shall have a front setback ofat least twenty(20)feet. 2. A one story wing or extension may be built to within eighteen inches(I8")ol'the rear lot line.However,if access to a garage or one-story carport is from the alley or an access easement,the minimum setback shall be twenty(20)feet for garages,or five (5)feet f or one story carports not having solid side walls.Setbacks shall be measured from the property line il'from an alley and/or from the casement line il'from an access easement. 3. In no case shall a,,ara a fronting onto a street be within twenty(20)feet ol'thc street property line. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two=Thousand and No/100 Dollars ($2,000.00) as provided in Section 40.01.006 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, section, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the intent of this Ordinance is to apply consistent changes to any portion of the Code of Ordinances of the City of Lubbock that is or may be affected by the changes provided herein. This Ordinance is also intended to apply consistent changes to any Ordinance that has been approved by the City Council of the City of Lubbock that is or may be affected by the changes provided herein. If this Ordinance has omitted any portion of the Code of Ordinances or any other Ordinance that should otherwise be affected by the changes provided herein, such omission is inadvertent and unintentional, and, upon the effective date of this Ordinance, any such omitted portion of the Code of Ordinances or other Ordinance shall be interpreted in such a manner as to comply with the changes provided herein. SECTION S. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law.
