HomeMy WebLinkAboutOrdinance - 1780-1955 - Authorizing City Health Officer To Make Inspections Any Commercial Bath House - 09/22/1955c==='==========================n= 09 -~~-l955 ORDINA.~CE NO. 1780 ----- AN ORDINANCE AUTHORIZING THE CITY HEALTH OFFICER TO MAKE INSPECTIONS AT ANY AND ALL REASONABLE TIMES OF ANY COMMER- CIAL BATH HOUSE IN THE CITY OF LUBBOCK WHICH EMPLOYS ANY M!\.TERIAL, SUBSTANCE OR MEDIUM OF ANY CHARACTER WH&TSOEVER FOR THE PURPOSE OF BATHING THE HUMAN BODY OR ANY PART THERE OF. TO DETERMINE WHETHER ALL ORDINANCES OF THE CITY OF LUB- BOCK AND LAWS OF THE STATE OF TEXAS FOR THE PRESERVATION OF HEALTH AND SANITATION ARE BEING COMPLIED WITH AND TO DETER- MINE WHETHER THE METHOD OF OPERATION OF SUCH BATH HOUSES JS SUCH AS WILL PERMIT CONTAMINATION OR THE SPREAD OF DISEAS~; REQUIRING THE OWNER OR PERSON IN CHARGE OF ANY SUCH BATH HOUSE TO CORRECT ANY CONDITION FOUND BY THE CITY HEALTH OF- FICER THAT CONSTITUTES A NUISANCE OR MENANCE TO THE PUBLIC HEALTH BEFORE CONTINUING THE OPERATION OF SAME: PROVIDING A PENALTY; AND DECLARING AN EM£RGENCY. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That the City Health Officer of the City of Lubbock BE, and he is hereby authorized to make inspections of any commercial bath house situated in the City of Lubbock which employs any material, substance or mediwn of any character whatsoever for the purpose of bathing human bodies or any part thereof. at any and all reasonable times to determine whether all ordinances of the City of Lubbock and laws of the State of Texas for the preservation of health and public sanitation are being complied with,,il.nd to determ:ne whether the m ,~thod of operation of such bath house is such as will permit contamination or the spread of diseases. SECTION 2. That in the event the City Health Officer, upon inspection of any such commercial bath house, has determined that the operation of same is in violation of any health or sanitation ordinance of the City of Lubbock or of any law of the State of Texas rc&uJ,at\l,l& J\eaJth and sanitation, or in any man- ner constitutes a nuisance or ntena~\;tlu; public health, it shall be the duty of the City Health Officer to so notiiy fu *r-i.ting the owner or person in charge of such commercial bath house, settinS fartn. the violations which must be ! eliminated and conditions which must l:>e met before such bath house may be again operated. After such owner or person in charge of such bath house has received such notice, he shall not continue the operation of same until a per- mit therefor has been issued by the City Health Officer upon application by sue owner or person in charge showing how the aforesaid violations have been eliminated and the conditions set forth in such notice have been made. Upon receipt of such application, the City Health Officer shall make inspection of such bath house and the premi.ses thereof to determine whether such violations have been eliminated and conditions met, all as required in said notice, and, in the event such conditions have been met and the violations eliminated, it shall be the duty of the Health Officer to issue such owner or person in charge a permit authorizing him to operate such bath house. SECTION 3. Any person operating any com..mercial bath house in violation of the terms of this ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in any sum not exceeding $ZOO. 00, and each day1s violation shall constitute a separate offense. SECTION 4. In addition to the penal provisions provided by this ordin- ance, the proper officers of the City may institute any appropriate action or proceedings, in law or in equity, to abate any nuisances or menaces to the public health which may exist by virtue of the operation of any commer- cial bath house in the City of Lubbock. SECTION 5. Due to the fact that the public interest, health and welfare require that all com:rnercial bath houses operated in the City of Lubbock be subject to immediate inspection, creates an emergency and a public neces- sity that the rule requiring proposed ordinances to be presented at two separate meetings be dispensed with; and this ordinance shall be effective from and after the date of its passage and publication as provided by law.
