AN ORDINANCE AUTHO~IZING TEB ALTERING AND CHANGING OF
THE PRIMA FACIE SPE£D LIMIT FROM 30 HILES PER HOUR TO 35
MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS:

WHEREAS, the governing body, as authorized by AL'~lcle 827a,
Seca 8, Vernon's Annotated Penal Code, finds that certain prima f~cie
speed limits on certain highways are diff~rent from what is reasonable
or safe and should be ~ltered an1 the immediate preservation of public
health and safety r equires immediate alteration of said prima facie
speed limits as hereafter set forth, which creates an emergercy;
NOW THEHEFORE,
BE IT ORDAINED BY THE CITY Cm~HSSI·:m OF Tl!E CITY OF LUBBO~K:
SECTION 1. The prima facie speed limit esi.<:t.lrli~:>LH~d by Arti-
cle 827a, Section 8, Subsection 1 (b)t V~rnon's Annot~ted reral Code,
is cltered and changed for all vehicles to 35 miles per hour on
the following designated highways or stree ts in the corporate limits
of the City of Lubbock, Lubbock County, Texas, to-wit:
On both sides of 50~ Street beginnin& at the West side of the inter-
section of 50~ Street and Avenue Q and extending to the East side of
the intersection of 50~ Street and Gary Avenue.
SECTION 26 The City Manager is authorized and u1rected to
cause the placing of signs so as to clearly define the l1mita of the
prima facie areas set out in this ordinance6
SSCTION 36 Any person, firm or corporation vio~~~ing the
_prima f acie speed limit establishet:i. h-,. tl'tis Ordinan(;e shall upon con-
viction be fined in any sum not to exce.ed TWO HUNDRED DOi...LARS($200.00)
and for subsequent violations within one year therea!~er shall be pro-
secuted as prescribed for such violations by Section 15 of Article
827a, Vernon's Annotated Penal Code.
SECTION 4. The City Secr~tRry is authoriz~d and directed to
cause the publication of the descriptive caption of this Ordinance to-
gether with the penalty provision ~~ ~~ alternative method of publi-
cation as provided by law.
SECTION 5· The fact that public necessity and convenience
requires that this Ordinance be passed as an emergency measure for
reasons set f orth in the preamble hereof, the rule r e quiring that no
Ordinance sha ll be finally passed on the day of its i ntroduction be
suspended, and this Ordinance is declared to be an emergency meas ure
to take effect from and after its passage.
