HomeMy WebLinkAboutResolution - 2020-R0002 - Dedication Deed - Betenbough Homes - 01/14/2020 Resolution No. 2020-R0002 Item No. 6.6 January 14, 2020 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor- of the City of Lubbock is hereby authorized and directed to accept for and on behalf of the City of Lubbock a Dedication Deed of Right-of-Way in connection with certain real property located in Section 23, Block AK, H.E. & W.T. RR. Co. Survey,Abstract No. 263, Lubbock County, "Texas, and all related documents. Said Dedication Deed is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. POPE, MAYOR ATTEST: Rebe ca Garza, City Secretary APPROVED AS TO CONTENT: Michael Keenum, P.E., Division Director of Engineering/City Engineer APPROVED AS TO FORM: Rya roo e, Assista City Attorney RES.Dedication Deed ROW Betenbough Homes, LLC 12.19.19 Resolution No. 2020-R0002 DEDICATION DEED OF RIGHT-OF-WAY STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § THAT, Betenbough Homes, LLC, herein called "GRANTOR", for good and valuable consideration due to the benefits accruing and to accrue to the remainder of GRANTOR's property by the presence of these easements, has by these presents, GRANTED and CONVEYED and by these presents does GRANT and CONVEY unto the City of Lubbock, for the use and benefit of the public for street, road, drainage, and public utility purposes, and for any other ancillary public use as usual and customary in connection therewith, as a street right-of-way, the free and uninterrupted use, liberty of passage in, on, along, over, upon, under, and across all that property lying and being situated in Lubbock County, Texas, and being more particularly described as follows, to-wit: A street dedication located in Section 23, Block AK, H.E. & W.T. RR. Co. Survey, Abstract No. 263, Lubbock County, Texas, and being situated within a portion of that certain 10.00 acre tract of land described in a Warranty Deed recorded in County Clerk's File Number 2009045344, and a portion of that certain 187.7459 acre tract of land described in a Warranty Deed recorded in County Clerk's File Number 2014000793 of the Official Public Records of Lubbock County, Texas,said street dedication contains 4.725 acres of land. Boundary more fully described by metes and bounds as follows: Beginning at spike found at the northeast corner of said Section 23 and near the centerline of Upland Avenue for the northeast corner of this tract and having coordinates of Northing 7,248,077.22 and Easting: 909,648.34, Texas Coordinate System of 1983 (2011),Texas North Central Zone; Thence S. 01° 50' 27" W., along the east line of said Section 23, a distance of 95.01 feet to a point near the centerline of Upland Avenue for the southeast corner of this tract; Thence N. 88° 09' 33" W., at a distance of 40.00 feet pass the west line of a Right-of-Way Easement recorded in Volume 782, Page 699 of the Deed Records of Lubbock County,Texas, continuing for a total distance of 55.00 feet to a 1/2"iron rod with a cap marked"Stevens RPLS 4339"set at a point of intersection and a corner of this tract; Thence N. 43° 09' 50" W. a distance of 42.42 to a 1/2" iron rod with a cap marked "Stevens RPLS 4339" set at a point of intersection and a corner of this tract; Thence N. 88° 10' 06" W., parallel with and 65.00 feet south of the north line of said Section 23, a distance of 219.75 feet to a 1/2" iron rod with a cap marked "Stevens RPLS 4339" set at a point of intersection and a corner of this tract; Thence N. 85° 18'21"W. a distance of 200.25 feet to a 1/2" iron rod with a cap marked "Stevens RPLS 4339"set at a point of intersection and a corner of this tract; Thence N. 88° 10' 06" W., parallel with and 55.00 feet south of the north line of said Section 23, at a distance of 202.40 feet pass a 1/2" iron rod with a cap marked "Stevens RPLS 4339" found in the west line of said 10.00 acre tract of land and the east line of said 187.7459 acre tract, at the northeast corner of the plat limits of Windstone at Upland,Lot 524-A&B, Lots 525 through 554, Lot 555-A&B and Lot 556-A&B,Lots 557 through 564,Lot 565- A & B and Lot 566-A & B, Lots 567 through 574, Lot 575-A & B and Lot 576-A & B, Lots 577 through 584, Lot 585-A&B and Tracts C and D,an addition to the City of Lubbock, Lubbock County,Texas, according to the plat, map and/or dedication deed thereof recorded in Plat and Dedication Number 2019003962 of the Official Public I Records of Lubbock County, Texas and having coordinates of Northing 7,248,044.86 and Easting: 908,939.95, Texas Coordinate System of 1983 (2011),Texas North Central Zone, continuing for a total distance of 3125.68 feet to a 1/2" iron rod with a cap marked "Stevens RPLS 4339" found in the west line of said I87.7459 acre tract for the southwest corner of this tract; Thence N. 01°51'45" E. a distance of 55.00 feet to a 1/2" iron rod with a cap marked"Stevens RPLS 4339" found in the north line of said Section 23 at the northwest corner of said 187.7459 acre tract for the northwest corner of this tract; Thence S. 88° 10' 06" E., along said section line and the centerline of 981' Street, a distance of 3630.41 feet to the Point of Beginning.Bearings are based on the Texas Coordinate System of 1983 (2011),Texas North Central Zone.
