WHEREAS, the City Council of the City of Lubbock, Texas deems it in the best interest of the citizens of the City of Lubbock to protect their health, safety, and welfare to make the following amendments to Chapter 4 of the Code of Ordinances with regard to the Animal Shelter Advisory Committee; and WHEREAS, the City Council hereby exercises its authority under Article 11, Section 5, of the Texas Constitution as a home rule city to enact regulations not inconsistent with the general laws of the State of Texas in the interest of the health, safety and welfare ofthe citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THAT Section 4·27 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Section 4-27. Animal Services Advisory Board. (a) There is hereby created an animal services advisory board. The board shall be composed of nine (9) persons with the following qualifications: one licensed veterinarian; one animal welfare organization representative; one city official, one city animal shelter employee and three (3) at-large persons. Persons appointed to such positions by the City Council shall serve for a term of two (2) years, so long as they do not fail to attend more than two (2) meetings of the board in succession. In that event, or in event of a resignation from the board, the City Council shall name a successor from the same representative group. (b) The board shall meet at least three (3) times each year and shall perform the following duties: (I) In an advisory capacity to assist the City of Lubbock in complying with the terms of the Texas Health and Safety Code, as amended; and (2) In an advisory capacity assist the city in establishing procedures applicable to the city's Animal Services program. SECTION 2. THAT violation of any provision of this ordinance shall be deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City ofLubbock, Texas. SECTION 3. THAT should any paragraph, section, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law.
