HomeMy WebLinkAboutOrdinance - 8389-1982 - Amending Sect. 28-57 Re: Due Date Of Water Bills; Late Payment Penalty - 01/27/1983JCR:cl ORDINANCE NO. 8389 AN ORDINANCE AMENDING SECTION 28-57 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK WITH REGARD TO THE DUE DATE FOR PAYMENT OF WATER BILLS, PROVIDING FOR A LATE PAYMENT PENALTY AND PROVIDING A SAVINGS CLAUSE. WHEREAS, Ordinance No. 8389 was passed on first reading on December 16, 1982, by the City Council of the City of Lubbock, and WHEREAS, Ordinance No. 8389 amended Section 34-14 of the Code of Ordi- nances of the City of Lubbock, and WHEREAS, the City Council of the City of Lubbock passed and adopted Ordi- nance No. 8371 which Ordinance recodified the Code of Ordinances of the City of Lubbock, and WHEREAS, Ordinance No. 8371 became effective January 1, 1983, and WHEREAS, Section 34-14 is now codified as Section 28-57 of the current Code of Ordinances of the City of Lubbock, and WHEREAS, the City Council of the City of Lubbock has determined that Ordinance No. 8389 be amended between first and second reading, and WHEREAS, second reading of Ordinance No. 8389 will take place on January 13, 1983, and WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of Lubbock that Section 28-57 of the current Code of Ordinances of the City of Lubbock be amended as follows, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-57 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Section 28-57. When bills due and payable. (a) (b) All bills for water consumed shall be due and payable fifteen (15) days after issuance. A penalty of five (5%) percent shall be charged! to the consumer if the consumer pays his bill after fifteen (15) days from issuance. The five (5%) percent late payment penalty shall apply to all classes of consumers served. As used in this Section, date of issuance shall mean the date when a bill is placed in the United States Mail, properly addressed to the consumer. .... SECTION 2. THAT the effective date of this Ordinance shall be March 1, 1983. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. AND IT IS SO ORDERED.
