AN ORDINANCE AMENDING SECTION 9-19 AND SECTION 9-20 OF THE CODE OF ORDI-
NANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO DUE DATE FOR PAYMENT OF
ELECTRIC BILLS, DISCONTINUANCE OF SERVICE FOR FAILURE TO PAY AND PROVIDING A
SAVINGS CLAUSE.
WHEREAS, Ordinance No. 8388 was passed on first reading on December 16,
1982 by the City Council of the City of Lubbock, and
WHEREAS, Ordinance No. 8388 amended Section 11-4 and Section 11-5 of the
Code of Ordinances of the City of Lubbock, and
WHEREAS, the City Council of the City of Lubbock passed and adopted
Ordinance No. 8371 which Ordinance recodified the Code of Ordinances of the
City of Lubbock, and
WHEREAS, Ordinance No. 8371 became effective January 1, 1983, and
WHEREAS, Section 11-4 and Section 11-5 are now codified as Section 9-19
and 9-20 of the current Code of Ordinances of the City of Lubbock, and
WHEREAS, the City Council of the City of Lubbock has directed that Ordi-
nance No. 8388 be amended between first and second reading, and
WHEREAS, second reading of Ordinance No. 8388 will take place on January
13, 1983, and
WHEREAS, the City Council deems it to be in the best interest of the
citizens of the City of Lubbock that Section 9-19 and 9-20 of the current Code
of Ordinances of the City of Lubbock be amended, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION I. THAT Section 9-19 and Section 9-20 of the Code of Ordi-
nances of the City of Lubbock, Texas be and is hereby amended to read as
follows:
Section 9-19. Payment.
The rates and charges provided for under this article shall become
due and payable fifteen (15) days after issuance, and such bill shall be
paid by the customer of such service at the office of Lubbock Power and
Light and Water.
Section 9-20. Discontinuance of service for failure to pay.
(a) Every user or customer of the City's electric light system shall pay
matured rates and charges within fifteen (15) days from the date the
same become due and payable as set forth in Section 9-19 of this
Code. Notice and opportunity for hearing will be given persons dis-

puting the amount of such rates and charges. In the event same are
not so paid, it is hereby made the duty of the director of electrical
utilities to disconnect electric service unless said user or customer
has appeared and shown substantial reason why such action should not
be taken. Whenever the amount past due and delinquent is paid by
such user or customer, such service may be resumed, but there shall
be charged and collected a reconnection charge of six dollars ($6.00)
for reconnection during normal working hours and fifteen dollars
($15.00) for reconnection outside normal working hours. Normal
working hours are 8:00 a.m. to 5:00 p.m. on weekdays excluding city
holidays. Such service shall also be disconnected when a user or
customer fails to pay for water service rendered by the city.
{b) As used in this article date of issuance shall mean the date when a
bill is placed in the United States Mail properly addressed to the
customer.
SECTION 2. THAT the effective date of this Ordinance shall be

March 1 , 1983.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
AND IT IS SO ORDERED.

I hand you herewith the Order and Resolution establishing late charges
and deposit requirements for electric service for both Southwestern Public
Service Company and Lubbock Power & Light. Also enclosed are Ordinance No.
8388 and 8389 which I have prepared in accordance with the instructions re-
ceived by the City Council at their meeting of December 16~ 1982.
